The police entered Marshall's home on Shaw Royd on June 29 of the previous year and confiscated a computer located in the dining area. An investigation of the device uncovered 183 images classified at the highest level of illegal material, Category A. It was determined that Marshall had started viewing these images from the day he acquired the computer on May 31, 2016.
Evidence also indicated that he had engaged in online chat rooms where participants discussed and shared such abusive imagery. Marshall admitted to possessing and creating indecent images of children, as well as possessing extreme pornography.
Representing Marshall, solicitor Kara Frith noted that her client had no prior convictions and had confessed to the offences early in the process. She stated, 'There is little more to say about the crimes. He accepts sole responsibility for accessing the material.'
The court heard that Marshall was prepared to seek help for his offending behavior and had the support of his family. As a result, he was sentenced to 16 months in prison, with the sentence suspended for two years. Additionally, he was instructed to participate in a 30-day rehabilitation program and will be required to register as a sex offender for five years.
