KEVIN FULLER SPARED JAIL IN NORTHALLERTON CHILD PORNOGRAPHY CASE
In April 2006, Kevin Fuller, a man with a notable military background from Northallerton, found himself at the center of a serious criminal investigation involving child pornography. Despite the disturbing nature of the evidence uncovered, Fuller was ultimately spared a custodial sentence, though he faced significant legal consequences.The case emerged when police officers, during an investigation into Fuller’s alleged involvement in money laundering activities in 2004, conducted searches of his property. These searches led to the discovery of a troubling collection of indecent images. Specifically, authorities found a total of 1,290 photographs depicting children engaged in sexual acts or posed in sexually explicit manners. These images were part of a larger collection of thousands of adult pornography, which police described as “vintage” material, indicating a focus on older or historical adult content.
Kevin Fuller, aged 50 at the time, was taken into custody and questioned regarding the images. During police interviews, he claimed that his interest in Victorian pornography was the reason behind his collection. He also stated that he had been sent the images of children, which he admitted he should have deleted from his computers. Fuller maintained, however, that he did not derive any sexual gratification from viewing the images, asserting that his intentions were not sexual but related to his interest in vintage adult material.
Fuller, residing at Prospect View in Northallerton, faced charges in connection with the possession of indecent images of children. He appeared before Teesside Crown Court, where he pleaded guilty to two specific charges concerning the possession of such images. The court proceedings revealed that the police had initially discovered the images during their investigation into Fuller’s financial dealings, specifically his alleged money laundering activities. A subsequent search of a different computer three months later uncovered an additional 400 images, further emphasizing the extent of his collection.
In sentencing, Judge Peter Armstrong acknowledged Fuller’s lengthy and apparently exemplary military service, which contrasted sharply with his criminal conduct. Despite this, the judge emphasized the seriousness of possessing child pornography. Fuller was sentenced to a two-year community rehabilitation order, which required him to participate in a sex offenders’ treatment program and to register on the sex offenders’ register. Additionally, the judge imposed strict conditions, forbidding Fuller from attempting to download any indecent images of individuals under 16 or any related material from the internet, unless such activity was directly related to his employment or educational pursuits.
During the proceedings, the court was informed that Fuller was currently unemployed. The prosecution’s case was presented by Rupert Dodswell, who highlighted that most of the images were uncovered during the initial investigation into Fuller’s financial activities. The police later found approximately 400 more images during a follow-up search, indicating a significant collection of illicit material.
James Kemp, representing Fuller in mitigation, argued that his client had inadvertently entered a dangerous realm of internet pornography. Kemp explained that Fuller had attempted to establish an online business centered around Victorian erotic photographs. He suggested that Fuller was unwittingly sent some of the illegal images and that his failure to delete them was an oversight rather than malicious intent. Kemp emphasized Fuller’s military service and the fact that he was now unemployed, portraying him as a man who had made a serious mistake.
Judge Armstrong concluded by warning about the risks associated with exploring such material online. He stated, “Those delving into this realm run the risk of ending up with indecent images of children on their computers. The trouble with them is that it involves real children being really and actually abused, and those who continue to download these things simply continue the trade in the abuse of children.” The court’s decision reflected the gravity of the offense, balanced against Fuller’s personal circumstances and the potential for rehabilitation.
