Lady Scott, presiding over the case at the High Court in Edinburgh, described how the woman recounted Millar 'exploding in rage' during the assault.

Despite Millar's denial of the offence, Lady Scott noted that her decision took into account his subsequent apology and the apparent shame he showed after the incident.

When questioned about this, he claimed that his only remorse was for the mental suffering caused, rather than the act itself.
Throughout the trial, Millar maintained that the woman was lying about the sexual assault.
Prosecutor Angela Gray described Millar as a man who had apologized to the woman for the rape, indicating some acknowledgment of guilt.
Meanwhile, defense lawyer Simon Gilbride explained that Millar, who is currently serving time in Edinburgh, had been struggling with personal issues, including the tragic death of a close friend.
He stated that Millar had turned to alcohol and drugs as a way to cope with his grief.
