    JONATHAN SIMPSON FROM WINSFORD AND LIVERPOOL FOUND GUILTY OF MURDERING TODDLER IN SPEKE

    In March 2021, a tragic case unfolded involving the death of a young boy named Jacob Marshall, whose life was brutally taken by his caregiver, Jonathan Simpson. Simpson, a 25-year-old man originally from Winsford but residing in Speke, was convicted of murder after a harrowing trial at Liverpool Crown Court that lasted twelve days.

    Jacob Marshall, a 22-month-old toddler, suffered a series of devastating injuries that ultimately led to his death. The injuries included extensive bruising across his head, stomach, groin, arms, shins, and feet. Notably, bruises were also found on his penis and two on his left inner ear. Medical examinations, including a CT scan, revealed a subdural haemorrhage—blood pooling and compressing his brain—and retinal haemorrhages involving significant bleeding in both eyes. Despite medical intervention, nothing could be done to save Jacob, and he succumbed to his head injuries late on Saturday, July 13, 2019.

    The court was informed that Simpson had offered to look after Jacob while his mother, Emma Marshall, went to the hairdresser. Simpson, who had no fixed address but was from Winsford, was supposed to care for the child at his home in Speke. However, the circumstances surrounding Jacob’s injuries raised serious concerns. A neighbor discovered Jacob unresponsive at his residence in Speke, but Simpson had not yet called an ambulance at that point. Instead, he provided multiple inconsistent explanations for the child's condition, initially claiming Jacob fell off a couch, then suggesting he dropped the boy down the stairs, and later reiterating that Jacob had fallen down the stairs.

    Simpson admitted that he lied initially about the cause of Jacob’s injuries, explaining that he did so because he believed admitting to leaving Jacob unsupervised would reflect poorly on his parenting. He denied ever intentionally hurting the child, but prosecutors argued that Simpson lost his temper and forcefully banged Jacob’s head on the kitchen floor, causing injuries comparable to those seen in a high-velocity car crash. The evidence presented in court painted a disturbing picture of abuse and neglect.

    The jury, after three hours and forty-nine minutes of deliberation, unanimously found Simpson guilty of murder. Throughout the verdict, Simpson showed no visible emotion in the dock, while Jacob’s mother, Emma Marshall, was seen sobbing, and members of her family were visibly distressed in the public gallery. Simpson’s mother was heard crying loudly, and his new girlfriend was also in tears. Judge Andrew Menary, QC, announced that Simpson would be sentenced the following morning and remanded him in custody. As Simpson left the dock, he waved to his mother.

    The court heard details of the day Jacob was injured. Emma Marshall, aged 23, had left her son watching television in his Mickey Mouse pajamas, with a fresh nappy and a bottle of juice, around 3 pm on July 12, 2019. She described Jacob as a “clumsy” child who was always running around and often had bruises, but also as a “happy, smiley little boy.” She recounted a previous incident in April when Jacob fell down the stairs, resulting in only a minor bump and a graze, which did not cause serious concern.

    Emma trusted Simpson, describing him as loving and affectionate towards her, Jacob, and her older son, who was six at the time. She expressed her panic when Simpson contacted her to say Jacob had fallen and that an ambulance was on its way. She rushed to Whiston Hospital, where she was met by her crying mother, two sisters, and Simpson himself. Medical staff quickly became suspicious of Simpson’s account, especially given the unexplained bruising on Jacob’s head, stomach, groin, arms, shins, and feet, as well as bruising to his penis and his left inner ear.

    Medical investigations revealed severe injuries consistent with abuse. The CT scan confirmed a subdural haemorrhage and extensive retinal bleeding. Jacob was declared dead late on Saturday, July 13, 2019. A Home Office pathologist testified that Jacob’s injuries were “highly suspicious of fatal child abuse,” emphasizing that such widespread injuries are very rare from falls alone. Dr. Jonathan Medcalf explained that falls down stairs very rarely result in death and that the injuries observed were inconsistent with a simple fall, noting the absence of carpet burns and other typical signs of such accidents.

    During the trial, the defense’s lawyer, Gordon Cole, QC, asked whether a fall down the stairs could be entirely ruled out, to which Dr. Medcalf responded that he could not rule it out as part of the incident, including possibilities like a push or a throw. The court also learned that Simpson had a criminal record, with six previous convictions between 2012 and 2016, including assault causing actual bodily harm and multiple battery offenses.

    Simpson’s account of the events was inconsistent. He claimed that after Emma Marshall left, he rolled a cigarette and smoked it by the back door. He then said he found Jacob unresponsive at the bottom of the stairs, with his foot caught in an open stair gate, and that he panicked. Simpson insisted he went to get help and carried Jacob to the kitchen because his phone was charging there, intending to call an ambulance. He denied going outside for a cigarette during the emergency call and claimed the call was cut off when his phone died, prompting him to move to another room to charge it.

    Under cross-examination, Simpson denied that Jacob was injured at around 3:15 pm, asserting that he delayed seeking help by about 30 minutes. He also denied causing the injuries himself, including shaking Jacob or hitting his head on the kitchen floor. When asked if he had planted a teddy bear to make his initial story seem more credible, Simpson did not respond. He later admitted to handing himself into police at Winsford Police Station around 8:45 pm on July 13, saying, “I’ve been good for three years, now I’ve gone and dropped a baby down the stairs.”

    Simpson’s reaction to his arrest was described by the prosecutor as “f***ing stupid, pathetic,” and he denied attempting to blame Emma Marshall for Jacob’s injuries via a text message. He did acknowledge that his comment about “baby gates” was a reference to making the house safer for Jacob.

    Judge Menary concluded the proceedings by thanking the jury for their service. He acknowledged the case’s difficulty, describing it as one of the most challenging cases courts will handle, and stated that the sentencing would take place the following day. The judge also reminded the jury of the emotional toll such cases can take and offered facilities for support if needed.
