The 71 illegal images were found on devices owned by 28-year-old Jonathan Atkinson, magistrates at the city’s Rickergate court heard. The defendant, of Hartley Avenue, admitted three offences.
The most serious related to him downloading 32 Category A child abuse images, including the video of the baby.
He also admitted downloading 20 Category C images and 19 Category B images. All the offences were committed between February 2021 and May 2023.
Prosecutor Diane Jackson explained that the offending came to light after Cumbria Police were contacted by an external law enforcement agency.
When officers raided the defendant’s home, they seized two iPhones and a Samsung mobile phone as well as a computer. Some of the offending images were on the iPhones.
Others had been stored in a cloud-based internet account. A police analysis of the images the defendant had accessed showed the youngest to be around two, and “not more than a baby,” said Mrs Jackson.
Chris Toms, defending, said he would not trouble the court with the defendant’s explanation for his actions. “But he pleaded guilty at the first opportunity and has been cooperative with the Probation Service,” said the lawyer.
Mr Toms said prison would serve no purpose other than to wreck the defendant’s personal life and his finances.
The lawyer pointed out that Atkinson was a man of previous good character but the publicity around the case would be a significant punishment.
Magistrates said the offending was so serious that only a custodial sentence was appropriate, but they suspended the one-year jail term they imposed for two years, with various conditions.
These include that Atkinson must complete 15 rehabilitation activity days with the Probation Service and 90 hours of unpaid work. He must be on the Sex Offender Register for a decade and be subject to a sexual harm prevention order for the same period, said the magistrates.
“We believe there is a realistic prospect of you not repeating these offences,” added the presiding magistrate as she concluded sentencing.
