In April 2021, a serious incident involving John Murphy, a known sex offender from Perth, has once again brought him into the spotlight due to a breach of court-ordered notification requirements.

Murphy, who was previously convicted of inappropriate conduct towards minors, appeared in Perth Sheriff Court to face charges related to his failure to comply with the conditions set by the court.

Murphy, aged 61 at the time, had been placed on the sex offenders’ register in November 2019 after admitting to approaching two 14-year-old girls at a McDonald’s restaurant located on Dunkeld Road in Perth.

During that earlier incident, he made explicit propositions to the teenagers, asking if they wanted to have sex with him.

The court had taken a stern view of his actions, emphasizing the seriousness of such misconduct involving minors.

Fast forward to the recent court appearance, Murphy pleaded guilty to breaching the Sexual Offences Act by failing to notify police of his circumstances within the required three-day period following his conviction.

The breach was identified when police visited his residence in Ballantine Place, Perth, after Murphy did not make the mandated contact within the stipulated timeframe.

This failure to comply with notification requirements is considered a serious violation of the legal obligations placed on registered sex offenders.

During the hearing, Fiscal Depute Andrew Harding outlined the circumstances, highlighting that Murphy had not adhered to the legal requirement to inform authorities about his whereabouts and personal circumstances.

Solicitor Billy Somerville requested leniency on behalf of Murphy, arguing that his client was not attempting to evade police or leave the country.

However, Sheriff Lindsay Foulis responded firmly, underscoring the importance of the legislation.

The sheriff pointed out that Murphy, nearly 60 years old at the time, had previously approached two young girls with inappropriate suggestions and had failed to comply with the notification laws designed to protect the community.

Sheriff Foulis emphasized that such breaches cannot be taken lightly, stating, “We are talking about someone who was almost 60-years-old and approached two 14-year-old girls and made inappropriate suggestions to them.

And then he did not comply with the sexual offences legislation regarding notification.

We can’t just tap him on the head and say go away and don’t do it again.” Murphy’s previous court history includes a 2019 case where he was ordered to complete a community payback order by Sheriff Keith O’Mahony.

At that time, Murphy had spent six weeks in remand, which was considered equivalent to a three-month jail term.

As part of his sentence, he was also required to undergo alcohol treatment and was placed under an 18-month supervision order.

The incident that led to his initial conviction occurred on September 25, 2019, at the Dunkeld Road McDonald’s.

During that earlier hearing, depute fiscal Mairi Graham detailed Murphy’s inappropriate conduct, noting that he was carrying a walking stick at the time and was heavily intoxicated.

Murphy approached the two 14-year-old girls and made explicit comments, including “I’m not too old,” suggesting he was interested in engaging in sexual activity with minors.

The court heard that his comments were clearly sexual in nature, and his intoxication and the fact that he was armed with a metal pole added to the severity of the incident.

Sheriff O’Mahony described the encounter as potentially frightening for the young girls and emphasized the gravity of Murphy’s actions.

In addition to placing Murphy on the sex offenders’ register for 18 months, the court also ordered him to undergo alcohol treatment and placed him under a supervision order to monitor his conduct moving forward.

During the recent proceedings, Sheriff Lindsay Foulis warned Murphy that any further breaches of the community payback order or failure to adhere to the conditions of his supervision could result in his imprisonment.

The court’s stance remains firm, underscoring the importance of community safety and the strict enforcement of laws designed to prevent reoffending by individuals with a history of sexual misconduct.
