April 2014 Callington man had who had more than 1000 child abuse images escapes jail A CALLINGTON man, who downloaded more than a thousand indecent images of children, has escaped jail. Police were led to John Malyon’s Florence Road address after a UK website was compromised in 2011. That legitimate site featured a portal leading to a website advertising the sale of DVDs containing child abuse. At Truro Crown Court on Friday, Elaine Hobson, for the Crown Prosecution Service, said a number of people accessed the link during the 57-hour period it was on the website and that police enquiries led officers to 58-year-old Malyon. His home was searched on April 5 last year and officers seized a laptop and a computer tower, which were found to contain child abuse images. Chris Spencer, for the defence, said Malyon had been in a 19-year relationship prior to his arrest but that his partner had thrown him out and that he had lost his job. Mr Spencer added that Malyon was hopeful that the relationship could be revived. He said: “He is determined to get back into work and to support his long term partner and obviously to work with the probation service.” Recorder Stephen Climie said he could only suspend a period of imprisonment if there was a chance of rehabilitation and voiced doubts in Malyon’s case. He said: “There are many [cases] where I read the pre-sentence report and the defendant is fully appreciative, both of his predilections and the need for them to be addressed.” He added that he was unsure if Malyon fell into this category. Mr Spencer urged Recorder Climie not to send Malyon to prison, where he said there was nothing in place to deal with his problems. Sentencing Malyon to 15 months in prison suspended for two years, Recorder Climie said: “I am troubled in your case by the extent to which you have fully understood and appreciated what you have done but I am just satisfied.” At an earlier hearing Malyon pleaded guilty to seven counts of making 1,056 indecent images between levels one to four on the scale police use to categorise such material, with level five being the most serious. The images were downloaded between June 27, 2011 and April 6, last year. Malyon was ordered to attend an internet sex offenders’ programme, to sign the sex offenders’ register and made the subject of a sexual offences prevention order. At Truro Crown Court on Thursday, John Malyon, of Florence Road, pleaded guilty to seven counts of making 1056 indecent images between levels one to four on the scale police use to categorise such material, with level five being the most serious. The images were downloaded between June 27, 2011 and April 6, last year. Judge John Neligan adjourned the case to March 14 for the preparation of a pre-sentence report and granted Malyon unconditional bail. Judge Neligan said: “Please do not take the indication of bail as any indication of sentence. “All of the sentencing options will be available to the judge.”
