    JASON EALES CAUGHT WITH CHILD ABUSE IMAGES IN HINCKLEY GETS LAST CHANCE FROM COURT

    In September 2011, a young man from Hinckley named Jason Elliott Eales was brought before Leicester Crown Court to face serious allegations related to the possession and distribution of indecent images of children. Eales, aged 23 at the time, had been found to have downloaded and stored a significant number of illegal images and videos depicting minors in exploitative situations, spanning a period from April 2008 to August 2009.

    According to the prosecution, Esther Harrison, police officers stopped Eales in his vehicle during a routine check. Their suspicions were raised when they discovered a computer tower inside his car. Upon inspection, the computer was found to contain numerous illegal images of underage children, which prompted further investigation. During police interviews, Eales denied any knowledge of the material stored on his device. He provided three different addresses where he had previously lived and named individuals who supposedly had access to his computer. However, subsequent interviews with these individuals revealed that they had not accessed Eales’s computer, indicating that his claims were false and that these explanations served as red herrings.

    Before sentencing, the court was shown a sample of the images, which included a range of disturbing content involving children under the age of 13, with some images depicting children as young as under five. The images were categorized into different levels of seriousness, with the most severe category, level five, containing four images, including three films. The collection also included 125 images and movies at level one, which is considered the lowest level of severity, and a total of 119 images and 41 films at level four, the most serious category. The content was particularly disturbing due to the age of the children involved, with some images involving children under five years old.

    In total, Eales was charged with ten counts of making indecent images, involving 326 images and movies. The charges covered various levels of severity, with 59 images and films at level two, 19 images and seven films at level three, and four images at level five. The images primarily depicted children under 13, with two of the children being under five years old.

    At the hearing, Judge Michael Pert QC acknowledged the disturbing nature of the material and expressed concern over the fact that a young man like Eales was interested in such content. The judge emphasized that Eales needed help and that the images he possessed were highly unusual and troubling. While considering the options, the judge decided against immediate imprisonment, opting instead to impose a community order. Eales was sentenced to a three-year community order, which included three years of supervision and a requirement to complete a three-year sex offender rehabilitation course. The judge also ordered the destruction of Eales’s computer equipment to prevent further access to such material.

    Furthermore, Eales was placed under a five-year sex offender prevention order. This order restricts his use of computers and other electronic devices, allowing authorities to monitor his activities and prevent unsupervised contact with children. Additionally, Eales was required to register as a sex offender for five years, ensuring ongoing oversight of his conduct.

    During mitigation, James Varley highlighted that Eales suffered from learning difficulties, had been bullied at school, and struggled to make friends. Mr. Varley stated that Eales had ceased viewing the illegal material a few weeks prior to his arrest. He explained that Eales had his computer in his car along with other belongings because he was in the process of moving address. The defense argued that Eales was a young man who had made a terrible mistake and that he was now bearing the shame of his actions in court, in front of his mother. The court’s decision reflected a balance between the need for punishment and the opportunity for rehabilitation, with the judge emphasizing that if Eales re-offended, prison would be the consequence.
