    In a disturbing case of animal neglect, Jamie McCabe, a resident of Hartlepool, was found guilty of causing unnecessary suffering to protected animals, specifically poultry, on his allotment located on Chester Road. The incident involved the abandonment and prolonged neglect of several birds, including hens and a duck, over a period stretching from late August to late September in 2016.

    According to evidence presented by the prosecution, represented by RSPCA prosecutor John Ellwood, the conditions on McCabe’s allotment were appalling. An emaciated duck was discovered in a makeshift pond on the property, lying alongside the remains of another duck. The scene suggested a grim scenario, with carcasses scattered on the ground that appeared to have been hastily brushed up, indicating an attempt to conceal the evidence of neglect.

    Further investigation by local authorities revealed the presence of three plastic sacks containing the remains of multiple dead poultry, including duck feet and feathers. These remains were reportedly collected with brushes, underscoring the neglect and the effort to hide the extent of the cruelty. The investigation also uncovered that three birds still alive at the site were severely malnourished, having been starved to the point of emaciation. Veterinarians estimated that these birds had been suffering from neglect for up to four weeks, a period during which they received inadequate food and water.

    During police interviews, McCabe admitted that most of the poultry had died, attributing their deaths to rats, which he believed had gotten to the birds. Despite his absence at the trial, the court found him guilty of causing unnecessary suffering to a protected animal. The neglect was deemed severe enough to warrant a conviction in his absence.

    Following the discovery, the remaining starved birds were rescued, treated by veterinarians, and eventually re-homed. The case drew attention to the serious issue of animal cruelty and neglect within the local community.

    In his defense, McCabe’s legal representative, Dave Smith, claimed that the defendant had contested the charges from the outset. Smith suggested that McCabe’s allotment had been “ambushed” by another allotment owner following a dispute. He explained that McCabe had been dealing with personal upheaval, including a recent diagnosis, which contributed to his failure to attend the trial. Smith also stated that McCabe acknowledged the incident was upsetting and expressed a desire not to keep poultry in the future.

    Sentencing was handed down with a combination of penalties: McCabe received an 18-week prison sentence, suspended for 12 months, along with an 18-week curfew. Additionally, he was disqualified from keeping any birds for the remainder of his life, a measure aimed at preventing future cruelty. The case highlights ongoing concerns about animal welfare and the importance of accountability for those who neglect or abuse animals in the Hartlepool area.
