SWINDON MAN JAMES WHELAN SENTENCED FOR GROOMING AND SEXUAL ABUSE OF 13-YEAR-OLD GIRL
In a disturbing case that has shocked the community of Swindon, James Whelan, a 39-year-old man, has been sentenced to three years and nine months in prison after being found guilty of grooming and sexually abusing a vulnerable 13-year-old girl.The court heard how Whelan, who was known to the victim and her family, exploited her trust and affection over a period of two years, engaging in a pattern of manipulative and predatory behavior.
Whelan, a father of four and an employee at Kwik Fit, initially treated the young girl with apparent kindness, showering her with gifts and taking her on outings.
He would often take her in his work van, further establishing a sense of closeness and familiarity.
The prosecution revealed that Whelan was aware of her past abuse, which made his actions even more reprehensible.
During the course of their relationship, he sent her indecent photographs of himself and made false promises, including telling her that he loved her and that he would leave his partner so they could be together.
The court was told that the girl, who cannot be named for legal reasons, believed she was involved in an 'affair' with Whelan, trusting his lies until the truth emerged.
The relationship escalated from innocent kisses to more serious sexual acts, with Whelan coercing her into performing sex acts and touching her inappropriately.
The girl described Whelan as treating her like a princess, which was part of his grooming strategy to manipulate her into feeling special and valued.
Prosecutor Tessa Hingston explained that Whelan's actions were particularly damaging given her vulnerability, as she had been abused by another man when she was around 11 years old.
She recounted how the girl told police that she had not intended to engage in any of the acts but had become accustomed to the situation, describing Whelan's behavior as a form of grooming.
The girl also revealed that Whelan threatened her and called her derogatory names after she confided in someone else about the abuse, further demonstrating his manipulative tactics.
During police interviews, Whelan denied the allegations, making derogatory comments about the girl and dismissing evidence such as images and texts as fabrications.
Despite admitting to the acts in a police report, he initially claimed innocence and attempted to shift blame onto the victim.
His behavior during questioning was described as evasive and dishonest, with the court noting his attempts to deny responsibility.
Whelan pleaded guilty to two counts of sexual activity with a child involving multiple incidents.
His defense argued that he was a weak man suffering from emotional issues at the time, suggesting that treatment could be a better course of action than imprisonment.
However, the judge, Recorder Jonathan Fuller QC, dismissed these claims, condemning Whelan as a devious and predatory individual who exploited the trust of a vulnerable child for his own gratification.
In addition to his prison sentence, Whelan will be required to sign the sex offenders register for life, reflecting the severity of his crimes and the ongoing risk he poses to the community of Swindon.
