In a case that has sent shockwaves through the community of Stirling and beyond, James McKinstrey, a 70-year-old man from Burnbank, Port of Mentieth, Stirling, was sentenced to serve two years in prison for serious allegations of child abuse.

The conviction followed a detailed trial at the High Court in Edinburgh, where McKinstrey was found guilty of four counts of sexual abuse committed during his time as a night watchman at the now-closed St Ninian's School.

St Ninian's School, located in Stirlingshire, was a facility operated by monks from the de la Salle order, primarily serving boys with behavioral issues during the 1960s and 1970s.

The institution was shut down in 1982, but the scars left by its dark history continue to affect former pupils and their families.

The court proceedings revealed a disturbing pattern of abuse, including physical violence, sexual misconduct, and psychological torment inflicted upon vulnerable children.

James McKinstrey's crimes, as detailed during the trial, involved heinous acts committed within the school’s dormitories and woodwork rooms.

Victims recounted being whipped, forced to eat their own vomit, and subjected to sexual abuse by staff members.

One former pupil, now aged 52, described a particularly harrowing incident where McKinstrey lost his temper and broke a boy’s arm.

The court also heard testimonies of pupils being physically tortured, including instances where they were made to hold metal rods connected to electrical generators, resulting in electric shocks.

One victim recounted being electrocuted in the school’s boot room, with Brother Benedict, as Murphy was known, observing the punishment and seemingly deriving some form of satisfaction from it.

Michael Murphy, 69, who was known as Brother Benedict and served as a housemaster at St Ninian’s, was convicted of 10 offences of physical abuse, including administering electric shocks.

His address was listed as Hill Brow, near Liss, in Hampshire.

Both Murphy and McKinstrey appeared before the court to be sentenced, with the judge, Lord Carloway, emphasizing that the breach of trust was evident and that prison sentences were unavoidable.

Despite pleas for leniency from representatives on behalf of the accused, the judge maintained that justice required these sentences.

The sentencing was met with outrage and disappointment from former pupils, many of whom expressed their disbelief at the relatively short prison terms.

One victim stated, “I am shocked at the sentences.

Two years is diabolical.” The community and victims alike continue to grapple with the legacy of abuse at St Ninian’s, which remains a stark reminder of the horrors that can occur within institutions meant to protect and nurture children.

The de la Salle order, which once managed the school, now faces ongoing claims for damages from those affected by the abuse, as the scars of the past remain painfully present.
