JAMES HILL

An individual named James Hill, employed as a social care assistant in Moray Council's home care services, has been given a two-year warning following serious misconduct issues.

The Scottish Social Services Council (SSSC) report detailed that Mr.

Hill engaged in behaviors that breached professional boundaries and demonstrated a lack of respect for the values required of his role.

Specifically, between September and December 2018, Mr.

Hill sent inappropriate and sexually suggestive text messages to a female colleague, including statements such as "poor old guys eyes pop out when they see you lol," "you've got some set," and sexual comments about his colleague’s physical appearance.

The SSSC described these actions as "sexually motivated" and an abuse of his position, noting concerns about the values held by someone willing to behave in such a sexually inappropriate manner towards colleagues.Although Mr.

Hill ceased sending messages once told of his colleague's discomfort, the report cited ongoing public protection concerns due to his conduct.

Additionally, he contacted a supported person’s daughter without permission, messaging her about her appearance and expressing interest in meeting her again, which made her feel uncomfortable.

The SSSC indicated this behavior was "of a serious nature" and constituted a breach of trust.

Furthermore, during his employment, Mr.

Hill verbally abused a supported person, swearing at them and making inappropriate comments about their clothing, such as "you're f***ing belt is tied" and "it's f***ing tight enough".The Scottish Social Services Council determined that a warning of two years on Mr.

Hill's registration was the appropriate penal sanction, given the circumstances.

The decision emphasized that his behavior demonstrated a disregard for the SSSC's codes of practice and the values expected from registered workers.

Despite the serious nature of his misconduct, the council considered that a warning was the most proportionate response, taking into account that Mr.

Hill did not send further inappropriate messages after being confronted, and the risk of repetition was deemed low.

Moray Council has been contacted for a comment regarding these findings.
