    In April 2022, a disturbing incident unfolded in Truro involving James Endean, a 22-year-old man with a history of domestic violence. Endean, who had previously served time in custody for assaulting his former partner, once again demonstrated a violent and reckless attitude towards those close to him. Despite his past, he managed to avoid immediate imprisonment following a brutal attack that endangered his own child.

    Endean appeared before Truro Crown Court to face charges of criminal damage, assault, and cruelty to a child, having pleaded guilty to these offences. The case was prosecuted by Michael Brown, who detailed the harrowing events that took place on the morning of September 23 of the previous year. At that time, Endean and his partner had been together for four years, sharing a nine-month-old son.

    The morning in question began with Endean waking up in a foul mood, which quickly escalated into a heated argument centered around childcare responsibilities. Endean accused his partner of neglecting their baby, and this disagreement soon devolved into a series of aggressive outbursts. Witnesses reported that Endean shouted loudly, punched, and kicked household items in a display of petulance. After stepping outside for a cigarette, he returned to the scene of the dispute, where tensions flared once more.

    Back inside, Endean’s partner was in the living room with their infant son. The argument resumed, this time over plans for the day. Endean, visibly angry, swore and told his partner she could not go to work because she had to stay home to care for their child. His anger culminated in him kicking a television and its stand in front of the crying baby, a reckless act that could have resulted in serious injury.

    According to prosecutor Michael Brown, the situation worsened when Endean’s partner attempted to diffuse the situation by offering to care for their son. In a shocking display of violence, Endean forcibly picked up his son and threw him across the room, a distance of approximately two meters. Fortunately, the mother was able to catch her child mid-air, preventing him from hitting the ground and sustaining injury. The court heard that Endean’s violent behavior did not end there; he pushed his partner in the back while she was holding their son, causing her to stumble. The incident prompted neighbors to call emergency services, and police arrived shortly thereafter.

    Endean’s conduct in court was described as a “brief but deliberate disregard for the welfare of his son,” highlighting the severity of his actions. Judge Anna Richardson addressed the court, emphasizing the gravity of throwing a small baby, which posed a high risk of causing serious harm. She noted that while the incident was a momentary lapse, it demonstrated a clear neglect of the child's safety and well-being. The judge also acknowledged that Endean had already faced the consequences of his previous actions, having lost custody of his children, and remarked on his apparent efforts to mature and recognize the need for change.

    As part of his sentence, Endean was handed a 10-month prison term, suspended for two years. He is required to complete a program aimed at building better relationships, along with a rehabilitation activity requirement. Additionally, a restraining order was issued to prevent any contact with his former partner, and he was ordered to pay her £450 in compensation for the distress caused.

    This case underscores the ongoing issues of domestic violence and the importance of intervention to protect vulnerable individuals, especially children, from harm caused by aggressive and violent behavior.
