JAMES BURCH FROM NEWPORT SENTENCED FOR SEXUAL ASSAULTS INVOLVING 12-YEAR-OLD RUNAWAY
In a case that has shocked the Newport community, James Burch, a 21-year-old man from the Ringland Centre area, has been sentenced to prison for his involvement in the sexual abuse of a 12-year-old runaway. The incident, which took place in September 2007, was brought to light during a trial held at Cardiff Crown Court last December, culminating in a conviction and subsequent sentencing in February 2011.During the four-day court proceedings, the jury was informed that the young boy, who was fleeing from a home where he endured physical and emotional abuse, found refuge with Burch. It was revealed that on the second day of his stay, Burch handed the boy a note that read, “you can only stay here if you let me do things to you and let me touch you.” This note marked a turning point in the case, as the boy later disclosed that he was subjected to sexual abuse following the receipt of the note. Despite the trauma, he chose not to report the abuse immediately, fearing repercussions and feeling too scared to speak out.
The boy eventually reported the incidents in January 2009, after he had been placed with a new foster family and felt safe enough to disclose what had happened. Burch, however, denied any involvement in the abuse, claiming that the boy fabricated the allegations because he knew where the runaway was staying. He also insisted that he had not engaged in any sexual contact with the boy and refused to undergo any psychological or behavioral interventions aimed at preventing future offenses.
Judge William Gaskell presided over the case and addressed Burch directly during sentencing. He acknowledged Burch’s troubled background, noting that he had suffered a “wretched” childhood and had been a victim himself in the past. Despite this understanding, the judge emphasized that Burch’s actions demonstrated a lack of remorse and awareness of the harm caused. “In light of what you experienced, you would have had some understanding of what effect what you were doing would have on this boy, but clearly you didn’t,” Judge Gaskell stated.
As a result, Burch was sentenced to 18 months in prison for each of the three counts of sexual assault, with all sentences to run concurrently. Additionally, he was placed under a sexual offences prevention order for five years, restricting his activities and contact to prevent any further harm. The case has left a lasting impact on the community, highlighting the importance of vigilance and support for vulnerable children in Newport and beyond.
