A disturbing case has emerged involving Harvey Vincent, who committed a serious sexual assault in Cardiff.

The incident took place when Vincent, who had just turned 18 years old, attacked a woman in her home under circumstances that have left her profoundly traumatized.

Despite the victim clearly stating that no sexual activity should occur between them, Vincent forcibly engaged with her while she was under the impression that she was asleep.

During a sentencing hearing at Cardiff Crown Court on Monday, it was revealed that the victim, who has been granted lifelong anonymity to protect her identity, was actually awake during the assault.

She described feeling paralyzed with fear, unable to move or respond as Vincent first sexually assaulted her and then forcibly engaged in sexual intercourse.

The victim expressed that her experience has fundamentally changed her, stating, "I am not the same person I was before being raped." The court heard that Vincent, who was under the influence of cocaine and alcohol at the time, disregarded her lack of response and continued his assault.

The victim had hoped that her silence would deter him, but he persisted regardless of her welfare.

Following the incident, a complaint was made to the police, leading to Vincent’s arrest.

He denied the charges initially, but after a trial, a jury found him guilty of rape and sexual assault by penetration.

It was noted during the proceedings that Vincent was of previous good character.

In a heartfelt victim personal statement, the woman detailed the profound impact the assault has had on her life.

She said, "Harvey raped me when I was just 18, just leaving school.

The hurt goes beyond the physical act; he raped my mind and my body.

I will never be able to trust someone like that again.

I’ve gained strength from this experience, but I have changed.

I am not the same person I was." She further described the ongoing psychological toll, including night terrors where she wakes up screaming and shouting Vincent’s name.

The victim shared her struggles with intimacy, revealing that she no longer enjoys contact sports or being touched, and expressed frustration with the justice system, stating, "The system does not work for victims; it re-victimizes and punishes us.

I feel sorry for you, Vincent, and for your friends and family.

This has changed my entire life." Despite the trauma, she expressed resilience, affirming her determination to rebuild her life.

She concluded by saying, "I will never feel responsible for this.

I will make a successful life for myself despite what he did.

I will walk with my head held high; he will not dictate the rest of my life." In mitigation, defence barrister Marian Lewis described the case as tragic, emphasizing that two young lives have been affected.

She pointed out that Vincent was only 18 at the time of the offence and argued that his life had been significantly impacted, noting his loss of good character and current struggles with depression, for which he is now on medication.

Judge Paul Hobson, in sentencing Vincent, acknowledged the severe psychological harm inflicted on the victim, who has engaged in self-harm and expressed suicidal thoughts since the assault.

Addressing Vincent directly, the judge stated, "Your actions, in ways big and small, have changed her life forever." Vincent, now aged 20, was sentenced to five years in a young offenders' institution.

The court ordered that he serve two-thirds of this sentence before being released on licence.

The judge also reduced the initial starting point of seven and a half years by a third, citing Vincent’s immaturity at the time of the offence.

Additionally, Vincent was ordered to register as a sex offender indefinitely and was subjected to a 10-year restraining order to protect the victim from further contact.
