A man from Hull, identified as George Toner, has been sentenced to six and a half years in prison following a serious incident involving a vulnerable woman.

The incident occurred amidst a period of heavy alcohol consumption, during which Toner, described as a 'functioning alcoholic,' had been drinking large quantities of vodka and beer on the night in question.

According to court proceedings, Toner, 48 years old and residing on Knightscourt, Orchard Park estate in Hull, targeted the woman after putting his arm around her during a conversation.

The woman responded with a firm 'Give over,' indicating her discomfort and lack of consent to his advances.

Despite her protests, Toner attempted to kiss her, forcibly sticking his tongue into her mouth, and ignored her repeated attempts to push him away.

The court heard that she told him to 'Pack it in,' but he persisted in his inappropriate behavior.

Witnesses and evidence presented during the trial indicated that Toner then sexually touched the woman, who was visibly distressed and crying, trying to push him off.

The situation escalated when Toner pinned her down and committed a sexual act against her will.

The woman sustained an injury during the assault and subsequently reported the incident to the police.

Following the assault, Toner reportedly apologized multiple times and eventually handed himself in at Clough Road police station.

During police interviews, he claimed that the incident was simply a 'drunken night' and insisted that any sexual activity was consensual.

However, the prosecution argued that Toner’s account was a fabrication, asserting that he either deliberately lied or was unable to recall the events due to his intoxication.

The evidence against him was described as 'overwhelming,' with the court noting that he had been heavily intoxicated, as bottles of vodka and cans of beer were found at the scene.

Prosecutor Claire Holmes detailed that Toner’s behavior was brazen and that his repeated apologies did not align with the fact that he was engaged in non-consensual sexual acts.

She emphasized that the woman was crying and trying to defend herself, making it clear that her protests were ignored.

The court also heard that Toner’s account of the events was inconsistent and that he had attempted to justify his actions by claiming they were consensual, which the jury ultimately rejected.

During the trial, the defense argued that Toner, despite being intoxicated, had a clear memory of the events and that his actions were not the result of blacking out or memory loss.

They maintained that any sexual activity was consensual.

Nevertheless, the jury convicted Toner of two of the four charges brought against him, acquitting him of the remaining two.

The court also imposed a 10-year restraining order to prevent any contact with the victim in the future.

At the time of sentencing, Toner was already in custody on remand, and the court’s decision reflected the severity of his actions and the impact on the victim.

The case highlights the dangers of alcohol-fueled violence and the importance of consent, especially when dealing with vulnerable individuals in Hull.
