GARETH DUGGAN AND SHOCKING SEXUAL ASSAULTS IN WARRINGTON

A police officer from Warrington who was accused of drunkenly sexually assaulting two colleagues at a festive work gathering has narrowly avoided imprisonment.

Instead, he was ordered to register as a sex offender and face a series of community-based sanctions.

Gareth Duggan, aged 38, was involved in the misconduct during a Christmas celebration held at a nightclub in Chester last year, an incident that has garnered significant public and media attention.

The charges stemmed from an event that took place during the holiday season when law enforcement officers from various regions gathered for a celebration.

According to court proceedings, Duggan’s behaviour included inappropriate physical contact directed at two fellow officers.

In one instance, he was accused of grabbing the bottom of one female colleague, while in another, he placed his hand beneath the dress of another female officer during the course of the night.

Despite prior rumours and suspicions that Duggan exhibited predatory tendencies, the victims initially questioned whether the allegations might have been fabricated in an attempt to secure career advancement.

These doubts persisted until the incident was formally reported and investigated.

The court heard detailed allegations from the victims, who described feeling shocked, uncomfortable, and distressed due to Duggan’s actions.

In court, prosecutor Alex Morgan outlined the details of both alleged assaults.

He explained that the victim who was touched on the bottom felt immediate shock and responded by kicking Duggan’s ankle in an attempt to make him cease his actions.

The other colleague recounted a similar experience, where Duggan held her for an extended period, squeezing her waist and making her feel extremely uncomfortable.

She also reported that Duggan placed his face near her neck, made kissing noises, and then touched her vagina over her clothing, a sequence of events that she described as deeply upsetting.

The court further learned that Duggan’s wife and the two victims watched the proceedings from the courtroom gallery, emphasising the personal and emotional dimensions of the case.

One of the victims, a detective specialising in rape cases, delivered a heartfelt statement.

She recalled being shocked when Duggan initially put his arm around her, but was utterly disgusted when he touched her in a sexual manner.

She expressed her difficulty in speaking out, fearing it could spoil the festive mood and cause her further distress.

She also disclosed that there had been circulating rumours within the police force suggesting Duggan was a predator who had previously assaulted someone, but she had not anticipated that she would be a victim herself.

The victim expressed frustration that Duggan received a full year on a sergeant’s salary despite the allegations.

She voiced her wish that the case had gone to trial so she could have had a voice in the proceedings.

Nonetheless, she stated her relief that Duggan is no longer in the police force, reaffirming her pride in serving as a police officer.

In mitigation, Duggan’s legal representative, Daniel Weed, argued that the officer had been suffering from post-traumatic stress disorder (PTSD), which stemmed from the hardships of front-line policing over the past 15 years.

He emphasised the toll that such intense and often traumatic experiences can take on mental health, suggesting that Duggan’s conduct might be linked to these psychological struggles.

Mr Weed acknowledged Duggan’s disgraceful actions and accepted that he would most likely be dismissed at the upcoming misconduct hearing scheduled for January.

Furthermore, the defence highlighted Duggan’s personal circumstances, including the impact on his wife, who had stood by him in court.

Mr Weed described Duggan as a “disgraced” and “broken” man, asserting that imprisonment would do more harm than good to his mental well-being.

Ultimately, District Judge Jack McGarva sentenced Duggan to a 32-week sentence, which was suspended, meaning he would not serve time in prison unless he committed further offenses.

Duggan was also ordered to complete 200 hours of unpaid community work, participate in 35 days of rehabilitative programs, sign the Sex Offender Register for seven years, and pay each of the two victims £1,000 in compensation.

Addressing Duggan directly, the judge emphasised the importance of public trust, particularly in law enforcement.

He stated, “You are a police officer and the public and your colleagues are entitled to look at you as an example and someone they can trust.

You completely failed them.” The judge referenced the misconduct of former police officer PC Wayne Couzens to illustrate the damaging effects of police misconduct and the erosion of public confidence.

The judge also highlighted the profound impact of Duggan’s actions on the victims.

He pointed out that the assaults were not minor or fleeting but involved significant physical contact that would likely haunt the victims for years.

“It was very significant contact which will probably live with them for the rest of their lives,” the judge remarked.

He concluded by noting that despite the challenging circumstances Duggan faced, his behaviour was entirely unacceptable, and ‘something very wrong’ had caused him to act out of character.

The court’s verdict underscores the necessity for police officers to maintain the highest standards of conduct and integrity, especially when entrusted with public safety.
