FRANCIS DOWNIE BUCKHAVEN CHILD ABUSER ESCAPES JAIL IN SCOTLAND
In November 2017, a disturbing case involving Francis Downie, a man from Buckhaven, came to light, revealing a history of inappropriate conduct towards a young child. The incident took place at the child's family home in Anstruther, Fife, where Downie, a known family friend and occasional babysitter, engaged in unacceptable and illegal behavior that would leave lasting scars.According to court reports, Downie, then aged 73, would sometimes be entrusted with babysitting duties at the family residence. During these times, he would sing popular songs from the hit band Liberty X, notably the track "Just A Little Bit," which contains the lyric "everything about you’s so sexy." This particular lyric seemed to have a disturbing effect on the young victim, who later described feeling increasingly uncomfortable whenever Downie sang it. The court heard that on one such occasion, the night of the assault, Downie’s actions crossed a line of propriety and legality.
Prosecutor Nicola Gillespie explained that during this incident, Downie touched the child's private parts over clothing while alone with the victim. The child, overwhelmed and frightened, ran to the bathroom crying and then sought refuge in a top bunk bedroom, sitting in a corner to escape the situation. When Downie attempted to coax the child back downstairs, the young victim tried to change the subject, clearly distressed by the encounter.
The victim kept the abuse secret for nearly 15 years, only deciding to come forward after a colleague disclosed her own history of abuse and reported it to the police. This revelation prompted the victim to reflect and eventually report the incident involving Downie. The police investigation was initiated on January 25 of that year, leading to Downie’s detention. During police interviews, Downie claimed he was not sexually aroused by the incident but expressed a disturbing belief that the child was "giving me the come on," indicating a troubling perception of the situation.
In court, Downie admitted to engaging in lewd, indecent, and libidinous practices towards the child between January 31, 2001, and January 30, 2003, at the Anstruther address. It was also revealed that Downie had a prior conviction for similar lewd practices dating back to 1965, highlighting a long history of concerning behavior.
The court, presided over by Sheriff Alastair Carmichael, considered the gravity of the offense but ultimately decided against imposing a custodial sentence. Instead, Downie was sentenced to a two-year probation order, with strict conditions including a ban on unsupervised contact with children under 16 and residence restrictions to approved accommodation. Additionally, he was placed on the sex offenders register for two years. Sheriff Carmichael remarked that while the offense was serious enough to warrant imprisonment, he chose to avoid a custodial sentence, emphasizing the importance of supervision and community safety.
