DAVID MORIARTY SENTENCED IN LIVERPOOL FOR SEX OFFENDER REGISTER BREACH
David Moriarty, 69, who was on the Sex Offenders Register for exposure, was jailed after repeatedly failing to comply with the conditions of his order.Liverpool Crown Court was told that Moriarty had breached the register multiple times, with his most recent breach occurring in October of the previous year.
During that incident, he did not notify police that he was of no fixed abode following his release from prison for another offence.
The court heard that Moriarty was a "hard working and intelligent man," but his life took a downward turn due to alcohol and drug addiction.
Prosecutor Michael Stephenson explained that Moriarty was first placed on the Sex Offenders Register in October 2015 for seven years after being jailed for exposure.
One key condition was that he must inform police of any change of address within three days.
Mr.
Stephenson stated: "Mr Moriarty was arrested and sentenced to eight weeks' imprisonment last October for possession of a controlled drug.
Upon his release, he was supposed to attend a police station within three days to notify them that he was of no fixed abode.
He failed to do so.
Instead, he voluntarily attended St Anne Street police station six days later, claiming he'd forgotten because he'd got out of the habit, and he was subsequently arrested for the breach.
It was a deliberate violation, and he should have been aware of his obligations." Defence lawyer Paul Becker acknowledged Moriarty’s poor compliance record, noting he had failed to comply eight times, amid a record of 44 previous convictions for 81 offences.
Becker mentioned Moriarty's background, including his education of eight O-levels and employment with British Rail, the ambulance service, and Royal Mail.
He added, "He fell on hard times, becoming addicted to alcohol and drugs, which led to his troubles." Becker also highlighted Moriarty’s health issues, including an unspecified neurological condition.
Moriarty has been in custody since November 4 for the breach, to which he pleaded guilty.
Judge Louise Brandon, who sentenced Moriarty via video link from HMP Altcourse, stated: "You have been a hard-working and intelligent man in your life, but since your lapse, your life has become chaotic." Moriarty was sentenced to 18 weeks in prison.
