DAVID MCMILLAN PERV FROM PERTH SENTENCED FOR SEXUAL OFFENCES AND LURE ATTEMPT
In October 2009, a disturbing case involving David McMillan, a 33-year-old man from Perth, culminated in his being sentenced to a minimum of 18 months in prison for serious sexual misconduct.The court proceedings revealed that McMillan had previously admitted to attempting to entice a 14-year-old girl to visit his residence in Perth, engaging in a series of phone calls and text messages that offered her alcohol and drugs in exchange for her company.
Details of the case showed that McMillan had breached a sexual offences prevention order (Sopo) shortly after his release from prison in 2008.
The breach involved him contacting the vulnerable teenager through calls and messages, despite the restrictions imposed on him.
McMillan claimed during the court hearing that he believed the girl was an adult, specifically 19 years old, which he argued was the reason for his actions.
He expressed a desire to withdraw his guilty plea and insisted on going to trial, asserting his innocence.
However, the presiding judge, Lord Brodie, dismissed McMillan’s request, stating, “It’s simply not something I can do,” and proceeded with the sentencing.
The court noted that McMillan had previously served a significant prison sentence, having been convicted 12 years earlier of raping a 73-year-old woman in Oban.
His original sentence was life imprisonment, but this was later reduced to nine years on appeal, leading to his release in 2002.
During the sentencing, Lord Brodie emphasized the seriousness of McMillan’s actions and the ongoing risk he posed.
The judge imposed a lifelong restriction order, meaning McMillan would only be eligible for release if the parole board determined he no longer represented a danger to the public.
Lord Brodie underscored the gravity of the case, stating, “This is not a trivial matter,” highlighting the potential threat posed by McMillan’s conduct and the importance of ongoing supervision and restrictions to protect the community from further harm.
