    DAVID MCGUIN SENT BACK TO PRISON IN PLYMOUTH FOR INTERNET OFFENSES

    In August 2010, the case of David McGuin, a man with a troubling criminal history linked to child exploitation, took a significant turn when he was re-incarcerated shortly after his release from prison. McGuin, a former Royal Navy sailor, had previously been convicted of downloading thousands of indecent images of children, a crime that led to his initial imprisonment and the imposition of strict court orders.

    McGuin, aged 39 and formerly residing at Lisson Grove in the Mutley area of Plymouth, had been subject to a Sexual Offences Prevention Order (SOPO) since September 2007. This order explicitly prohibited him from owning any devices capable of internet access, a measure designed to prevent further offenses. Despite this, Plymouth Crown Court heard that within just five days of being released from Dartmoor Prison, McGuin was found in possession of multiple electronic devices that could facilitate illegal activity.

    Specifically, police discovered a new laptop computer, a mobile phone, a USB memory stick, and a dongle that provided internet connectivity. These items would have enabled McGuin to download and store indecent images and videos, raising immediate concerns about potential violations of his SOPO. When questioned, McGuin admitted to breaching the court order, acknowledging that he had been caught with these devices shortly after his release.

    Prosecutor David Gittins explained that McGuin was released from Dartmoor Prison on June 23. Two days later, he informed authorities that he was staying at The Rooms Hotel on Union Street, as required by the sex offenders' register. However, on June 28, a police officer visited the hotel to check on him. McGuin was initially reluctant to allow entry but eventually admitted to the officer that he was aware he had been caught and expressed a willingness to return to jail.

    During the police inspection, the officer found the aforementioned electronic devices connected to the internet. Notably, the police had not yet examined the contents of the devices at that time. McGuin's defense lawyer, Nigel Hall, argued that his client had purchased the laptop and phone to seek employment and accommodation, and that his intentions were not malicious. Hall claimed McGuin was remorseful and had no intention of downloading child pornography, asserting that his client simply wanted to move on with his life.

    However, Judge Francis Gilbert QC was unimpressed with these explanations. He emphasized the seriousness of McGuin's criminal record, which included three convictions for creating indecent images of children. The judge pointed out that McGuin's prediction about returning to jail was accurate, highlighting his blatant disregard for court orders. The judge remarked that McGuin's explanation for possessing the devices was not credible and suggested that he had been contemplating resuming his previous harmful habits.

    Consequently, Judge Gilbert sentenced McGuin to three years in prison, to run concurrently with his existing sentence. The court also ordered the confiscation and disposal of all electronic equipment found in his possession. This case underscores the ongoing challenges faced by authorities in monitoring and controlling individuals with a history of child exploitation offenses, especially when they attempt to circumvent legal restrictions through new technology.
