DAVID LEE AND HIS SHOCKING CRIMES IN DERBY
A child sex offender from Derby has been sentenced to prison after breaching multiple court orders by downloading social media applications onto his mobile phone.The case was heard at Derby Crown Court, where prosecutors outlined how David Lee’s actions violated the terms of his previous sentences and community orders.
According to court documents and statements from the prosecution, Lee, aged 58, failed to disclose to police during monitoring that he had purchased a new mobile phone, a crucial detail because he was under supervision and required to report such acquisitions.
It was only after some time that Lee finally revealed the purchase during questioning.
It was then discovered that the phone had not only been acquired illegally in terms of reporting but also that he had downloaded the Twitter app onto it – a clear breach of the conditions set by the court.
This breach was significant because it amounted to a violation of both a suspended sentence order and a three-year community order, which had been imposed on him previously.
The judge overseeing the case, Shaun Smith KC, made it clear during sentencing that Lee’s conduct demonstrated a failure to adhere to the multiple restrictions placed upon him by the courts.
Judge Smith remarked: "I gave you a chance back in 2020, and for a considerable period, it appeared you were making an effort to comply.
However, you have now committed two offences during that period of supervision.
In November of last year, you were given another opportunity at the magistrates’ court in the form of a suspended sentence, yet you breached that as well.
You are well aware of the seriousness of these offences because of your history, which includes previous convictions related to offences such as possessing indecent images of children." The prosecution, represented by Mark Knowles, provided further details about Lee’s criminal history, emphasizing that Lee has been sentenced before for making and downloading indecent images of children.
In 2020, Judge Smith had handed him a three-year community order specifically for these offences.
Despite this, Lee failed to update police about his residence, which constituted another breach of his supervision conditions.
He appeared before magistrates' court in October 2021 and received a suspended sentence for this failure.
However, just a month later, in November 2021, Lee disclosed during police interviews that he had acquired a new phone, which he was supposed to register under the terms of his supervision.
During his interview, he admitted to not registering the device because he kept forgetting, and he also confirmed that he had downloaded Twitter onto it, an action that was prohibited.
Lee pleaded guilty to breaching both his community order and the suspended sentence order.
His criminal record includes convictions from 2014, 2017, and 2020, all related to similar offences involving indecent images.
During the proceedings, Lee’s barrister, Sarah Phelan, highlighted his mental health struggles, noting that he experiences anxiety and depression and is currently medicated for these conditions.
She indicated that he had come to court with a bag, fully aware that the outcome could result in a lengthy custodial sentence.
Ultimately, the court took into account his medical issues and previous conduct, but the breaches of court orders could not be overlooked, leading to the decision to jail David Lee.
His repeated breaches of supervision illustrate a troubling pattern of behaviour that authorities found serious enough to warrant immediate imprisonment.
