DANIEL ARCHIBALD FROM CIRENCESTER ESCAPES JAIL AFTER SEX WITH 13-YEAR-OLD GIRL

In a case that has drawn significant attention in Cirencester, Daniel Archibald, an 18-year-old resident of Whiteway View, narrowly avoided imprisonment after admitting to engaging in sexual activity with a 13-year-old girl. The incident, which took place on June 6 of the previous year, has raised serious concerns about the offender's prior behavior and mental health.

Archibald was previously known to authorities for his troubling fascination with young girls. In November 2011, police visited him at Cirencester College after he disclosed having sexual fantasies about girls as young as 12, describing his feelings as 'out of control.' This early intervention highlighted the severity of his obsession and prompted police to monitor his activities closely.

Further complicating the case, it was revealed that Archibald's father had taken the step of banning him from possessing a mobile phone after discovering that he had been sending sexually explicit messages. Despite this restriction, Archibald managed to obtain another phone, which ultimately became a key piece of evidence. His stepmother came across a message on this device that explicitly indicated he had engaged in sexual relations with the 13-year-old girl.

During the court proceedings at Gloucester Crown Court, it was established that Archibald had admitted to having sexual activity with the minor. Prosecutor Anna Vigars explained that the victim had initially connected with Archibald through mutual friends and had exchanged sexually explicit messages with him prior to the incident. On the night in question, the girl stayed over at a friend's house, where she and Archibald engaged in sexual intercourse.

Ms. Vigars noted that the girl did not explicitly object to the act at the time but later expressed regret, stating she had not truly wanted to go through with it. Following the incident, she decided not to pursue a relationship with Archibald and sent him a text message about their night together. This message was later seen by Archibald's stepmother, who reported it to the authorities.

It was also revealed that Archibald believed the girl was 15 years old, unaware of her actual age, and was under the impression that she attended school. His defense lawyer, Dermot Clarke, argued that Archibald had not initially perceived his actions as serious but had come to understand the gravity of his offense. Clarke expressed concern that incarceration would have a damaging effect on Archibald, potentially leaving him in a worse state than he was before.

Judge William Hart acknowledged the seriousness of the case, emphasizing the devastating impact that custody could have on the young man. Ultimately, he sentenced Archibald to 12 months in jail, suspended for two years, and ordered him to undergo two years of intensive supervision. Additionally, Archibald was subjected to a 16-week curfew from 9 pm to 6 am. The judge also highlighted the concerning nature of Archibald's preoccupation with sexual activity involving minors, suggesting that he might be drawn to younger girls due to similarities in emotional and intellectual development.

As part of his sentence, Archibald is required to sign the sex offenders register for a period of ten years, reflecting the court's recognition of the ongoing risk and the need for monitoring.
