CHRISTOPHER EWAN, A PAEDOPHILE NURSE FROM LIVERPOOL, SPARED JAIL AFTER DOWNLOAD OF CHILD ABUSE IMAGES
A nurse with a history of abusing trust has avoided prison after being convicted of possessing child abuse images, with the court acknowledging he had "lost everything" due to his actions.Married and a father of four, Christopher Ewan, 45, formerly worked at Aintree Hospital’s accident and emergency department in Fazakerley.
During the COVID-19 lockdown, he downloaded over 100 files depicting child rape as well as extreme pornography depicting bestiality.
Liverpool Crown Court was told that once his crimes were revealed, vigilantes targeted his family’s home in Netherton, causing his wife and children to flee for their safety.
Ewan’s legal representative explained that "in every sense the defendant has suffered significantly - but it's all down to him." His arrest was triggered by police noticing "suspicious activity" on his Sky broadband account and Kik Messenger, a messaging app, last summer.
On June 26, 2020, officers raided his former residence on Musker Drive and retrieved his Samsung mobile phone.
During police interviews, Ewan denied any knowledge of indecent images.
However, examination of his device revealed 137 Category A files, the most serious category involving child rape imagery, including 127 photos and 10 videos.
Additionally, there were 217 Category B images, 130 Category C files, one prohibited cartoon image, and 21 extreme pornographic images, all downloaded between March 3 and June 23 of the previous year.
Prosecutor Christopher Hopkins stated, "A lot of these were thumbnail images, but there was evidence of them being saved on the device.
Notably, there was a secure folder with suspicious activity." Among the images found was a Category A picture of a female baby aged six to 12 months, and a 24-minute-long video showing children aged eight, seven, and four.
Mr.
Hopkins emphasized that "these are particularly serious images in the Crown's submission." Ewan pleaded guilty to three counts of downloading and one of possessing indecent images of children, as well as possessing a prohibited cartoon and extreme pornography.
A pre-sentence report indicated he claimed he did not intentionally download the images nor did he seek sexual gratification from them, but he has since admitted this was untrue.
Defence lawyer Desmond Lennon acknowledged his client's guilt, stating, "He unreservedly accepts deliberately downloading this material.
He also accepts at the time there was a sexual interest in children and the notes indicate he still does." Mr.
Lennon explained that Ewan, who had been married for 19 years with four children, initially developed an interest in adult pornography, describing it as "thrill seeking," which later progressed to viewing images of child sexual abuse.
He noted that Ewan had been off work due to stress.
The lawyer argued that if Ewan were spared jail, he might receive the help he now recognizes he needs.
He added, "He understands how it's not only affected him, but people who are very important to him—his wife and children." Ewan’s wife had left him, the marriage had ended, and his four children had been taken away.
The family, living in Netherton, suffered significant repercussions when his crimes became public, including vandalism of their home, with bricks thrown through windows and paint sprayed on the door, alongside intimidating gatherings outside.
Ewan has not seen his children since July; communication has been intermittent.
A letter from The Walton Centre revealed that he suffers from muscular degenerative issues and is currently deemed unfit to work by the Department for Work and Pensions.
His career in nursing, which he entered after retraining as an engineer at age 30 and which he has worked in since 2010, is effectively over.
Ewan will not be permitted to practice as a nurse again and is likely to be struck off the register—an outcome described by Lennon as "all down to him," with Ewan having "lost everything in real terms." Despite the severity of his crimes, Lennon expressed hope for his client's rehabilitation, emphasizing his feelings of "shame, regret, and disgust." Justice Anil Murray addressed Ewan directly, stating, "You were of previous good character.
More than that, more than just having no previous convictions, you were of positive good character and worked as a professional person.
By this offending you have thrown all that away." He highlighted the profound impact on Ewan’s family.
The judge explained that sentencing guidelines typically recommend a 12-month prison term but increased this due to the seriousness of the Category A images.
After a one-third reduction for early guilty pleas, he sentenced Ewan to 10 months in prison, suspended for two years, along with a 40-day Rehabilitation Activity Requirement.
The court did not impose a punitive element involving unpaid work, citing concerns about Ewan’s focus being on sitting at a computer.
He was also ordered to sign the Sex Offenders Register and abide by a Sexual Harm Prevention Order for ten years.
