A man named Brian Melucci faces the possibility of imprisonment after an alarming incident at a supermarket in North Shields, Newcastle.

The case involves disturbing behavior involving peering into women’s toilets, which has led to his conviction on serious charges.

The incident occurred on April 11 at the Tesco Extra located on Norham Road in North Shields.

A female shopper was in the process of using the restroom when she was startled by an unwelcome sight.

According to her testimony, she entered the supermarket’s women’s toilets around 7.15am and noticed that the middle cubicle was occupied.

As she was about to flush her toilet, her attention was diverted when she heard shuffling sounds and the door closing behind her.

While she was on her phone and preparing to leave, she happened to glance toward the floor of the cubicle and was shocked to see a man’s head beneath the partition.

She described his position as if he was lying on the floor, with an object in his hand that she was unable to identify.

The woman initially thought he might be a child, as the situation was peculiar and unexpected, especially in a public restroom, which is usually used for private acts.

Recognizing the inappropriate nature of the scene, she instinctively kicked her foot and demanded answers from the individual she believed was Melucci.

Without delay, she pulled her trousers up, opened her cubicle door, and saw Melucci making his way to the exit of the toilets.

When she followed him around the supermarket, she tried repeatedly to get his attention, but he ignored her and appeared to be smug, leisurely walking past her without acknowledging her presence.

The victim was certain that the face she saw beneath the cubicle was that of Brian Melucci.

CCTV footage was shown in court, depicting her observing and following Melucci throughout the store.

The footage corroborated her account, as she repeatedly attempted to confront him.

However, Melucci did not respond and exited the premises shortly afterward.

Melucci, aged 24 and residing in Norfolk Gardens, Wallsend, admitted to entering the women’s toilets during the incident but claimed it was unintentional.

He stated that he had been at a party the previous night and was heavily intoxicated, which he claimed had caused him to lose awareness of his whereabouts.

Melucci insisted he did not recognize what he was doing until after his arrest and maintained that he was not doing anything wrong.

The court heard that Melucci has prior convictions related to exposure, assault, and criminal damage, which heightened concerns about his pattern of behavior.

His defense, represented by Jonathan Stirland, argued that the man seen peering under the cubicle could have been wrongly identified.

Stirland emphasized that the defense was not asserting that Melucci was not the person in the footage but challenged the conclusion that it was necessarily his intent or participation.

The prosecutor, David Ward, countered these claims by asserting that the CCTV clearly showed Melucci following the victim, and that the only plausible purpose for his presence in that situation was for sexual gratification.

He dismissed the defense's suggestion that circumstances were ambiguous, emphasizing that there was no other person present in the toilet and that the evidence pointed unequivocally to Melucci’s guilt.

Ward described the act as a deliberate attempt to observe a person in a private moment, which is a serious breach of public decency.

The case was brought before the North Tyneside Magistrates' Court, where the bench, chaired by David Dawson, convicted Melucci on both charges: observing a person doing a private act for sexual gratification and breaching a sexual harm prevention order.

The magistrates indicated that the case would now proceed to Newcastle Crown Court for sentencing, scheduled for July 11.

In delivering the verdict, the magistrates confirmed that the evidence established Melucci was the individual peering under the cubicle and that his actions were motivated by intent for sexual gratification.

They emphasized that no reasonable explanation other than his desire for such gratification could justify his behavior, reaffirming the severity of such misconduct and the importance of holding offenders accountable in cases like this.
