BRIAN GIBSON FROM REDCAR ESCAPES JAIL AFTER DOWNLOAD OF CHILD ABUSE IMAGES

In September 2010, a case involving Brian Gibson, a naturist from Redcar, drew significant attention at Teesside Crown Court due to the serious nature of his online activities. Gibson, a 53-year-old divorcee, was found to have downloaded a staggering total of 9,169 indecent images of children, including three video files depicting child abuse. Despite the gravity of these findings, he was ultimately spared a custodial sentence, though he faced other legal consequences.

During a police search of his residence on September 6 of the previous year, officers discovered the extensive collection of illicit material on Gibson’s computer. When questioned, Gibson attempted to downplay the nature of the content, asserting, “There will be photographs of adults and children naked. It’s all naturist stuff.” He further claimed that the images of nude children were collected from the internet and insisted that he was more interested in faces rather than bodies. The court was informed that Gibson had deleted all but two of the illegal images, which suggests an awareness of their illegality and an attempt to conceal them.

Most of the images found on his device fell into the lowest category of illegal content, but notably, 490 images were classified as more serious, including approximately 140 duplicates. The court heard that these images represented a significant breach of law, with the presence of more severe material raising the stakes of the case. Judge Peter Fox QC, the Recorder of Middlesbrough, addressed Gibson directly, stating that he had lost his good character due to his actions. The judge rejected the defense’s argument that the more serious child sex abuse images constituted only a “small number,” emphasizing the broader implications of such material.

Judge Fox made a stark statement about the nature of the illegal content, asserting, “The people who create these images in the first place, and who put them on to the web for people like you to download, and of course pay money to download these images of child sex abuse, are themselves abusing the children.” He underscored the fact that consumers like Gibson contribute directly to the demand for such material, which perpetuates a “pernicious and dreadful” market. While acknowledging that Gibson’s interest in naturism was lawful and innocent, the judge explained how child pornographers had managed to push illegal images alongside legal naturist photographs, blurring the lines for unwitting viewers.

Judge Fox noted that Gibson had deleted most of the illegal images, but emphasized the seriousness of the remaining content, which included 348 original images of a more severe nature. Given these facts, the court initially considered a prison sentence appropriate. However, taking into account Gibson’s good references and personal circumstances, the judge decided to suspend the 26-week prison term for two years. As part of his sentence, Gibson will be subject to supervision, required to attend a sex offender treatment program, and will be registered as a sex offender. Gibson had previously admitted to 17 counts of making indecent photographs of children, and his defense attorney, Graham Brown, clarified that there was no evidence to suggest that Gibson distributed the images, only that he had downloaded them.
