BERNARD MARSHALL OF HULL CAUGHT WITH 5,000 CHILD INDECENT IMAGES AND ANIMAL VIDEOS
In September 2016, a disturbing case emerged involving Bernard Marshall, a 72-year-old resident of Bellfield Avenue in east Hull, who was found to possess an alarming collection of indecent images of children along with videos depicting animals engaged in sexual acts.The police investigation revealed that Marshall had developed a troubling fascination with such material, which he accessed over a span of five years.
Authorities seized his computers after discovering that he had used a credit card to sign up for an illegal website hosting explicit content involving minors.
The site also contained graphic videos, including one showing a woman engaging in sexual activity with dogs.
During police interviews, Marshall admitted to viewing these images and videos, acknowledging that he first encountered them when pop-up advertisements appeared on his screen.
He explained that he found the images appealing at first, but later recognized the wrongfulness of his actions.
Marshall's digital devices contained a total of 164 images classified as Category A, which depicted the most severe and explicit material involving very young children.
Additionally, there were 154 images in Category B and a staggering 4,682 images in Category C.
He also downloaded two videos, lasting 22 and 35 minutes respectively, which showed a woman having sex with dogs.
Marshall pleaded guilty to eight counts of possessing indecent images and extreme pornographic material.
The court heard that some of the more explicit images might have been downloaded unintentionally, possibly as a by-product of his interest in less severe material.
However, it was clear that he had deliberately downloaded the two videos of animals engaging in sexual acts.
Marshall admitted to viewing and saving these videos, initially not perceiving them as wrong but later recognizing their criminal nature.
During the proceedings, Richard Thompson, representing Marshall, explained that the pensioner’s interest in illegal material began when indecent images of children appeared on his screen while browsing Japanese adult websites featuring underage teenagers.
He noted that Marshall has a history of mental health issues and that his engagement with such material was over a prolonged period.
Thompson emphasized that Marshall allowed himself to be drawn into the use of illegal content, developing a fascination with certain types of images, predominantly in Category C, which he claimed he deleted quickly from his computer.
In sentencing, Recorder Simon Jackson QC imposed a 20-month prison term, suspended for two years, and mandated that Marshall attend the Northumbria Sex Offender Treatment Programme.
The judge acknowledged that some of the extreme material may have been downloaded inadvertently, but made it clear that if it had been proven that Marshall had deliberately sought or paid for the most extreme content, the sentence would have been immediate.
The court’s decision took into account Marshall’s age, health, guilty plea, and lack of a prior record of seeking out such extreme material.
