ANTHONY HART FROM BURNLEY ESCAPES JAIL AFTER SEXUAL ASSAULT ON TEENAGE GIRL
In a recent case heard at Burnley Crown Court, Anthony Hart, a 22-year-old man from Burnley, was involved in an incident that left a teenage girl frightened and distressed.Despite the serious nature of the assault, Hart was handed a suspended sentence, sparking concern among community members and legal observers alike.
According to court reports, Hart was subject to a Sexual Offences Prevention Order at the time of the incident, which he did not breach.
The court clarified that the victim was not under 16, which influenced the legal proceedings.
Nonetheless, the details of the assault revealed a disturbing pattern of behavior that caused significant emotional harm to the young girl.
The prosecution described how Hart pushed the girl onto the floor, causing her to sit on the ground, and then proceeded to squeeze her wrists tightly.
He also attempted to kiss her neck, actions that left her visibly scared and crying.
The girl repeatedly told him to stop, but Hart's actions continued.
Prosecutor Austin Welch recounted that Hart asked the girl if she had ever slept with a man and suggested he would like to sleep with her, which added a layer of predatory intent to the incident.
Further reports indicated that Hart sat next to the girl on a settee and made another attempt to assault her.
When she tried to move away, he grabbed her, demonstrating a clear disregard for her personal boundaries and consent.
Following the incident, Hart was arrested and taken in for questioning.
During his police interview, he chose to remain silent, making no comment to any of the questions posed to him.
Hart, who was residing on Spencer Street in Burnley at the time, admitted to the sexual assault on January 19.
His legal history is extensive, dating back to 2005 when he was a juvenile.
Notably, in October 2009, he was convicted of detaining a schoolgirl without lawful authority after she was found hiding in his bedroom.
In April 2011, he admitted to engaging in sexual activity with a female under 16.
In sentencing, Hart received a custodial term of 18 months, which was suspended for two years, meaning he would not serve time unless he committed another offence within that period.
He had already spent nearly seven months on remand, equivalent to a 14-month sentence, which was taken into account.
The court also imposed a two-year supervision order.
James Heyworth, representing Hart, explained that his client had generally lived alone and tended to associate more comfortably with younger individuals, often in their mid-teens.
He noted that Hart's social functioning appeared atypical for his age and that his mental health had been adversely affected by his time in custody.
The defense highlighted these factors, suggesting that Hart's behavior might be influenced by underlying mental health issues, which had worsened during his period of detention.
