March 2015 School cleaner who spied on girls in toilet is jailed A CLEANER who spied on a teenage girl using toilets at a school in Birmingham has been jailed. The horrified victim told the court that she looked down in the cubicle to see Alexandro Zavao’s eye staring up at her from the neighbouring one. She screamed and Zavao fled, but after the alarm was raised and when police viewed CCTV they were able to identify the defendant. At Birmingham Crown Court Zavao was sentenced to ten weeks in prison and told by District Judge Ian Strongman: “It seems to me there is clear evidence that you deliberately abused your position of trust.” Zavao, 40, of Wake Green Road, Moseley, who had previously admitted a charge of observing another person doing a private act for the purpose of sexual gratification, was also ordered to register as a sex offender for seven years. The incident happened in May last year at the Sutton Coldfield school. Jim Mason, prosecuting, said: “The victim was using the toilet when her phone lit up. She looked down and could see this eye staring at her. “She screamed and it moved away,” said Jim Mason prosecuting. The two girls later told the deputy head mistress what had happened. Mr Mason said the victim had been left “shocked and angry” by what had happened. Abid Hussain, defending, said Zavao had been hired by an agency and it was his first day at the school. He said he wanted to use the toilet and because of his lack of knowledge of English he had gone in to the ladies by mistake. Mr Hussain said the offence had not been premeditated and as a result of his conviction he had become unemployable and his wife had asked him to move out. District Judge Strongman said: “As a cleaner you would be entitled to go into the girl’s toilets as part of your duties. “That means, necessarily, that you are in a position of trust. “As soon as you realised some girls had come in you should have made your presence known and left. “Instead you waited until they went into the cubicles and looked underneath where the girl was using the toilet. “It was a teenage girl and she was understandably alarmed. “It seems to me there is clear evidence that you deliberately abused your position of trust.” January 2015 Sutton Coldfield school cleaner spied on teenage girl in toilets A teenage girl using toilets at a Sutton Coldfield school was shocked to see a cleaner spying on her from underneath a cubicle. Alexandro Zavao, 40, of Wake Green Road, Moseley, pleaded guilty to observing another person doing a private act for the purpose of sexual gratification. City magistrates adjourned sentence until February 12 for reports to be prepared and Zavao was given conditional bail. Jim Mason, prosecuting, said two girls had gone into the toilets, which were reserved for years nine and 10 and situated off the main corridor, at about 3pm. They had gone into separate cubicles and one of them put her phone on the floor. “That lit up. She looked down at the phone and could see an eye staring at her from under the right side of the cubicle, “ said Mr Mason. “She screamed and she and her friend later told the deputy head mistress what had happened.” In a statement the teenager said: “I thought, at first, it must have been another pupil messing around. I was really angry and shocked by what had happened.” Police later viewed CCTV and were easily able to identify the defendant. Mr Mason said as a result of the incident both the girls suffered from anxiety if they had to use a public toilet. Abid Hussain, defending, said Zavao, who had been employed by an agency and spoke little English, was of previous good character. It had been his first day at work and the whole incident only lasted for about three minutes. He said it was not accepted that it had been a pre meditated or deliberate act. Mr Hussain said Zavao who had arrived at the school shortly before, had indicated to a supervisor that he wanted to use a toilet by making a washing motion and he had been pointed in the direction of the toilets. His wife had recently given birth and he had been unemployed since.
