Aidan McHugh, 21 years old, has been placed on the sex offenders’ register and ordered to undertake community service after being convicted earlier this year.
McHugh, living in Plains, has failed in his attempt to get his name removed from the official sex offenders’ list.
He contacted legal representatives to challenge his registration at the Court of Criminal Appeal in Edinburgh.
He was convicted at Airdrie Sheriff Court for a breach of the peace that occurred in October of last year, resulting in his placement on the register and a requirement to complete 80 hours of community work.
The court was informed that McHugh gained access to a woman’s phone—who cannot be identified publicly—at her residence in the town.
He claimed he wanted to access his Facebook account but ended up finding and copying an explicit image.
His defense described him as “a very immature 21-year-old,” mentioning that he took a copy of the image and shared it with a friend.
After the woman discovered what had happened, she contacted the police, leading to McHugh’s arrest.
