ADRIAN KOLCZAK SHOCKS KIRKCALDY WITH SEXUAL ASSAULT IN HIS HOME

A disturbing incident unfolded in Kirkcaldy when a woman was subjected to a sexual assault by Adrian Kolczak, a 35-year-old man, after she had initially shown him kindness and allowed him into her residence. The events began on a cold night when Kolczak, who had been left outside in the freezing temperatures by his partner, was found shivering in his car. The woman, acting out of compassion, approached him and offered assistance, unaware of the danger that would soon follow.

According to court reports, Kolczak took advantage of her goodwill. He sexually assaulted her at another address in Kirkcaldy, where he stood over her and engaged in a series of invasive acts. He put his hand under her pyjama top, seized her breasts, and pulled her top down to expose her. He then kissed her stomach, pulled down her pyjama trousers, and repeatedly kissed her pubic area. The assault was described as aggressive and invasive, leaving the victim feeling violated and disgusted.

Depute fiscal Rachel Hill provided details of the victim’s account. She explained that at the time, the woman lived near Kolczak’s then-partner but did not have a close relationship with either of them. The incident began around 2 a.m. when the woman heard a noise outside her home. Upon investigation, she saw Kolczak in the street, visibly intoxicated. She approached him and learned he had been 'kicked out' and planned to spend the night in his car. Showing kindness, she made him a coffee and allowed him to leave with it.

Later that night, at approximately 3:50 a.m., the woman checked on Kolczak in his car and found him shivering from the cold. She again invited him into her home to warm up, but initially, he declined. However, at around 4:55 a.m., she heard him shouting and banging on his partner’s door. Concerned, she went outside once more and told him he was welcome to come inside her home to escape the cold. This time, he accepted her offer and was directed to a sofa. Yet, Kolczak’s intentions appeared to shift as he asked, 'Are we going to bed?'

Feeling uneasy and unable to trust him to stay out of her bedroom, the woman chose to remain in the living room and stay awake. Despite her caution, Kolczak began making inappropriate comments about her appearance, calling her 'beautiful,' and questioning why she was not in a relationship. The situation escalated early in the morning when, at around 7 a.m., her son’s alarm went off, signaling the start of the day. Just half an hour later, the woman briefly closed her eyes. When she opened them, she found Kolczak standing over her, having grabbed her pyjama top and exposing her breasts. She fought back, struggling to free herself as he pulled down her pyjama bottoms and started kissing her stomach and then her private parts.

In a desperate attempt to defend herself, she punched Kolczak repeatedly, shouting, 'How f****** dare you. That’s sexual assault.' Following the assault, Kolczak apologized and even attempted to shake her hand, an act that underscored the gravity of the situation. The woman was left feeling foolish for having let him into her home, yet also deeply violated and disgusted by his actions.

Adrian Kolczak, of Church Street, Kirkcaldy, appeared before the town’s sheriff court, accompanied by a translator. He admitted to the sexual assault that occurred on 28th March 2023 at another address in Kirkcaldy. The court heard the details of his actions, which included standing over the woman, touching her inappropriately, and forcibly kissing her. The prosecution highlighted the victim’s lack of familiarity with Kolczak and her initial act of kindness that was exploited.

Sheriff Robert More ordered a report and scheduled Kolczak’s sentencing for 12th May. As part of his sentence, Kolczak has been placed on the sex offenders register, reflecting the serious nature of his crimes and the impact on the victim. The case underscores the importance of vigilance and the devastating consequences when trust is betrayed in such circumstances.
