AARON ELPHICK ESCAPES JAIL IN STALYBRIDGE CASE AS MOTHER SPEAKS OUT OVER CHILD SEX OFFENCE
In May 2005, a mother has spoken out in frustration over what she calls a 'travesty of justice' after Aaron Elphick, 24, was sentenced to no jail time for engaging in a sexual act with a 13-year-old girl. Elphick had invited a group of teenage girls into his home in Stalybridge and subsequently engaged in sexual activity with one of them. The victim's mother, aged 31, revealed that her daughter has struggled immensely since the incident, attempting to take her own life, refusing to attend school, and spending most days in bed.The mother expressed her distress, saying, 'I want my daughter back. She was a normal teenager but now she doesn’t eat, doesn’t sleep and doesn’t go out. It makes me shiver to think Elphick has his freedom while my daughter is suffering every day. It’s a travesty, he has stolen her childhood.'
The incident took place on September 25 of the previous year, involving four girls who visited Elphick’s home. Prosecutor Lisa Judge stated that Elphick was found smoking cannabis and drinking alcohol, while the girls were drinking but not smoking. The sexual encounter occurred after Elphick followed the 13-year-old girl to the bathroom. When questioned by police, Elphick claimed that the girl had behaved in a sexual manner towards him.
During sentencing at Manchester Crown Court, Judge Stuart Fish condemned Elphick’s conduct, remarking, 'It was wholly inappropriate behaviour on your part to behave in such a way when you, as an adult, should have been protecting her, you should have said no. It must be made clear I am not seeking to push the blame onto the complainant. Your criminality is that you took advantage of her for your own pleasures when an opportunity was presented to you.'
Elphick, of Spindlewood Close, pleaded guilty to having sex with a child. The court imposed a three-year community rehabilitation order, ordered him to register as a sex offender, and mandated participation in a sexual offenders’ programme.
