LEVEN WOMAN SENTENCED TO REGISTER AND FINED FOR SENDING EXPLICIT PHOTO TO GRANDMOTHER
A 59-year-old woman from Leven has been placed on the Sex Offenders Register for a period of five years after sending a photo of a partially-naked man to his grandmother.Wilma Thomson was also fined and ordered to pay compensation during her sentencing at Kirkcaldy Sheriff Court.
She previously admitted to intentionally causing a woman to view a sexual image by sending her a photograph of her grandson in a state of undress on November 22 of last year.
This act is considered an offence under Section 6 of the Sexual Offences (Scotland) Act 2009.
Prosecutor Amy Robertson told the court that the Facebook message contained a photo of the woman's grandson in a “partially naked state, lying on a bed.” The prosecutor explained that the woman discovered the image on her phone, which showed her grandson “partially naked while asleep and (his) genitals were visible.” She reported the incident to authorities.
Thomson, also known as Wilma McColl according to court documents, fully admitted her actions during a police interview and was formally charged.
She appeared in court again for sentencing after background reports were prepared.
Defence attorney Danielle Stringer stated that Thomson, of Coronation Crescent, Leven, accepted responsibility at the earliest opportunity.
She referred to a social work report that provided details of the case but explained in open court that “the situation had been unfolding” before the incident.
Ms.
Stringer highlighted that there had been ongoing tension between the parties involved and that Thomson regrets her retaliatory response.
She also acknowledged that her actions likely caused the complainant distress.
Sheriff Steven Borthwick imposed a fine of £335 on Thomson and ordered her to pay £250 in compensation.
