In December 2019, a disturbing case involving Toby Yates, a 31-year-old mathematics teacher from Stenson Fields, has come to light in Derby. Yates, who was employed at Chellaston Academy, has admitted to multiple serious charges related to the sexual abuse of underage girls, with the allegations spanning over a period of time and involving more than one victim.

Yates appeared before Derby Crown Court on a Tuesday, where he pleaded guilty to a series of charges that included engaging in sexual activity with a girl aged between 13 and 15, as well as with a girl aged 13 to 17, while abusing a position of trust. The court heard that at least one of these offenses involved Yates having full sexual intercourse with the second victim inside a classroom at Chellaston Academy. The incident was part of a broader pattern of misconduct that Yates had previously admitted to, with the court already aware of his earlier guilty pleas concerning the sexual abuse of a teenage girl.

The court was packed with spectators, including the parents of the second girl, who was also a victim. These parents were present to witness Yates’s guilty plea, which was entered during a hearing that lasted nearly half an hour. The victim’s identity remains protected by law, but her parents’ presence underscored the gravity of the case. Yates, dressed in a blue open-necked shirt and grey trousers, sat quietly during the proceedings, staring straight ahead and showing no outward emotion or acknowledgment of the courtroom audience.

During the hearing, Yates confirmed his identity before admitting to two counts of engaging in sexual activity with a girl aged 13 to 15, four counts of sexual activity with a girl aged 13 to 17 while abusing a position of trust, and additional charges including causing or inciting sexual activity with a girl aged 13 to 17. He also pleaded guilty to possessing extreme pornographic images and making two indecent images of a child. The judge, Robert Egbuna, ordered that Yates’s sentencing be postponed until March 6, and he was remanded into custody pending the sentencing.

Judge Egbuna stated that a psychiatric report would be prepared to provide the court with a better understanding of Yates’s mental state before sentencing. Prosecutor Jonathan Straw requested that the sentencing hearing be scheduled for a Friday afternoon, as the second victim, now attending university, wished to return to Derby to deliver her victim impact statement in person.

Yates’s criminal history includes a guilty plea in August for inciting a girl to engage in sexual activity while he was in a position of trust. During that hearing, he also admitted to making multiple indecent photographs of children, including two of the most serious Category A images, two Category B images, and 83 Category C images. Yates, who resides on Merevale Way, has no prior convictions before these offenses.

In a related case from August 2019, Yates had already pleaded guilty to sexually abusing a teenage girl. At that time, he appeared before Derby Crown Court to answer for his actions, which involved inciting a girl to engage in sexual activity. His case was adjourned until September 16, and he was remanded into custody until that date. The ongoing proceedings highlight the serious nature of his misconduct and the breach of trust involved in his role as an educator at Chellaston Academy, raising concerns about safeguarding and the protection of students in Derby.
