The prosecution, led by Brian Reece, clarified that Gale did not touch the girl beneath her clothing but engaged in inappropriate behavior by becoming overly affectionate and placing his arm around her. Reece stated that Gale had touched her inner thigh and was close to her private parts, actions that caused the girl to become visibly shaken and frightened. It was also revealed that Gale had been drinking at the time, consuming approximately seven cans of beer, which contributed to his behavior. The court noted that Gale claimed he was trying to warm the girl up by touching her, even admitting in an interview that he might be attracted to her when she is older.

Defense attorney Anthony Abell expressed remorse on Gale’s behalf, acknowledging that his actions were wrong and inappropriate. Abell suggested that Gale may have found the girl attractive, but emphasized that he understands the gravity of his misconduct and the distress caused to the victim. The judge, in her sentencing remarks, highlighted the troubling nature of Gale’s behavior, noting that he pressed himself against the girl, causing her significant distress. She also pointed out that Gale had anticipated the possibility of imprisonment, stating that he expected to go to jail for his actions but still chose to proceed.

As part of his sentence, Gale will be registered as a sex offender for ten years, a measure that requires him to inform authorities of his residence and comply with monitoring protocols.
