CHESTERFIELD MAN THOMAS CUNNINGHAM SENTENCED FOR SEXUAL ABUSE IN THE 1970S

In August 2006, a case that has sparked widespread outrage and discussions about sentencing laws unfolded in Derby Crown Court involving Thomas Cunningham, a 59-year-old resident of Spencer Street, Chesterfield.

Cunningham pleaded guilty to five counts of indecent assault committed between 1971 and 1975, during which his young victim was between nine and twelve years old.

Despite the gravity of the crimes, Cunningham was sentenced to a relatively short term of two years in prison.

Additionally, he was ordered to register as a sex offender for ten years and was disqualified from working with children, measures that many consider insufficient given the nature of his offenses.

The victim, a woman now aged 43 and also residing in Chesterfield, chose to remain anonymous but expressed her profound disappointment and outrage at the leniency of the sentence.

She criticized the legal system for applying historical sentencing standards, noting that the crimes took place in the 1970s when different laws and punishments were in effect.

She stated, “I am disgusted.

He would have received a 14-year sentence if he had committed the same crimes today and pleaded not guilty, or seven years if he pleaded guilty now.” She further questioned the fairness of applying outdated sentencing guidelines, saying, “I don’t understand why somebody can get a sentence that they would have received in 1972 for this crime.

It just doesn’t seem fair.” The abuse took place initially in Matlock, where the victim was subjected to repeated assaults several times a week.

The abuse continued even after Cunningham moved to Chesterfield, only ending when the victim finally found the courage to confront him and stand up against his actions.

The long-lasting impact of the abuse has been deeply felt by the woman, who has suffered from post-traumatic stress disorder, depression, and anxiety attacks.

These mental health struggles eventually led her to seek professional counseling a few years prior to speaking out publicly.

She shared, “It was only after counseling that I felt empowered enough to report the abuse.

I had always believed that you just got over things and moved on, but then I realized I couldn’t let this happen to anyone else.

I felt angry and determined to bring it into the open.” She emphasized the importance of speaking out, adding, “I would definitely advise others to come forward because these crimes need to be exposed.

No amount of counseling can make you feel how I felt when he was led away.”
