A man from Dunfermline, Stuart Mitchell, narrowly avoided a prison sentence after being convicted of assaulting his former partner in a violent incident that resulted in severe injuries.

The assault took place at Mitchell’s residence on Law Road, where he and his partner had been drinking and arguing, leading to a brutal confrontation that left her with a broken nose, a fractured cheekbone, and the loss of ten teeth.

According to court proceedings at Dunfermline Sheriff Court, the incident occurred on the night of October 20 last year.

Mitchell, aged 41, admitted to assaulting his former partner during an altercation that unfolded within his home.

The court heard that Mitchell had attempted to forcibly remove her from his property after an argument that escalated following a night of drinking.

During the incident, he physically seized her by the body, dragged her from a couch along the floor, and ultimately ejected her from the premises.

The court was told that the assault intensified when Mitchell grabbed her by the hair, pulled her onto the floor, and dragged her toward a door.

In the process, he pushed her body, causing her to hit her head against the door frame with force, resulting in serious injuries.

The woman was subsequently taken to hospital, where medical examinations confirmed she had sustained a fractured nose, a hairline fracture to her right cheekbone, and that ten of her teeth had to be extracted due to the trauma.

Details of the incident revealed that the couple had been together for four years prior to the assault.

On the night in question, they had been drinking together at Mitchell’s house.

Around 1 a.m., an argument broke out, and Mitchell went to bed, leaving his partner still drinking in the living room.

Before dawn, specifically before 6 a.m., Mitchell got up and asked her to either go to bed or leave, citing the upcoming arrival of his child.

The woman refused to comply and began verbally abusing him, which led Mitchell to react violently by attacking her and forcibly dragging her out of the flat.

At one point, she started banging on the door, prompting Mitchell to allow her back inside.

However, a further struggle ensued when she knocked over a coffee table, smashing the glass.

Mitchell then dragged her back toward the door, during which she struck her face against the door frame, causing her injuries.

The court noted that the woman’s injuries were severe, requiring hospital treatment.

During the hearing, Mitchell’s defence solicitor, Jenny Simpson, stated that the woman had admitted to tipping over the coffee table three times to annoy her partner, which she claimed caused Mitchell to lose his temper.

The court was also informed that Mitchell’s actions went beyond reasonable force, with Sheriff Charles Macnair emphasizing that the circumstances of the case were “unusual.” In light of the evidence, Sheriff Macnair imposed a community payback order with 12 months’ supervision and a restriction of liberty order for four months.

While acknowledging the seriousness of the assault, the sheriff decided against a custodial sentence, opting instead for these community-based penalties to address the case.
