UNCLE JAILED FOR KILLING OF NEPHEW
A man who fatally stabbed his nephew during a dispute has received a prison sentence.Shane Seymour, 44 years old, “lost control” and used a kitchen knife to kill Daniel Mock, the court at Nottingham Crown heard.
However, Seymour was convicted of manslaughter instead of murder after evidence was presented to show his learning disability and unusual circumstances contributed to reduced responsibility.
The defendant, from Spruce Gardens in Bulwell, was sentenced to seven years and four months in prison.
Outside the court, Seymour’s brother stated that the incident had caused the family to break apart.
Judge John Burgess, in delivering the sentence, described how Seymour and Daniel Mock, aged 37, had been living together for several months.
The judge noted that Seymour found this arrangement challenging, partly because Mr.
Mock stayed up late, hosted noisy friends, and smoked cannabis.
"Your requests for him to leave seem to have been ignored Judge Burgess said.
"It is obvious now with hindsight that it was a very bad idea that he should come to live with you," The court heard that on August 2, 2019, an argument erupted, leading Seymour to stab his nephew multiple times with a kitchen knife.
Although Seymour pleaded guilty to manslaughter, he was initially facing charges of murder.
During the proceedings, the prosecution altered its stance after new information emerged, recognizing his learning disability as a key factor and dropping the murder charge.
The judge remarked, "Your learning disability coupled with the circumstances reduce your responsibility for his death."
