ROBERT STEWART FROM LOSSIEUMOUTH SENTENCED FOR UNDER-AGE SEX OFFENSES IN INVERNESS
In a case that has drawn significant attention from the local community in Lossiemouth and beyond, Robert Stewart, a 43-year-old engineer, was sentenced to 16 months in prison for engaging in sexual activity with a teenage girl. The incident, which occurred at Stewart's residence in Lossiemouth, took place between May 5 and May 17, 2003, when the girl was only 13 years old.Stewart's actions came to light after the girl confided in a friend about the incident, and her mother subsequently discovered her daughter's disclosures later that month. The matter was promptly reported to the police, leading to Stewart's arrest and subsequent court proceedings. During his initial appearance at Elgin Sheriff Court on May 21, 2003, Stewart denied the allegations. He was released on bail but failed to attend his scheduled trial on May 6, 2004, which resulted in further legal complications.
At the time of the offense, Stewart was reportedly under the influence of alcohol and was only dressed in his boxer shorts. According to court reports, the girl had entered Stewart's bed and fallen asleep. She awoke during the night to find Stewart awake as well. The two then began to kiss and cuddle, and Stewart allegedly asked her if she wanted to have sex. Although initially refusing, the girl was reportedly coerced into sexual activity after Stewart persisted. The court heard that this was a single incident, but it left a lasting impact on the victim and her family.
During the trial, Stewart's defense, represented by advocate David Moggach, highlighted the numerous tragedies he had endured, including the sudden death of his wife in 2000, followed closely by the loss of his father and young son. Moggach stated that Stewart had begun to drink more heavily following these personal tragedies and claimed that his client had no recollection of the events involving the teenage girl. Stewart, who later changed his plea to guilty, expressed remorse for his actions and was described as being 'thoroughly ashamed' of what had transpired.
In sentencing, Sheriff Alexander Pollock emphasized the seriousness of the offense, particularly given Stewart's age and the vulnerability of the young girl involved. The court sentenced Stewart to 16 months in prison, with the sentence being backdated to November 10 of the previous year, when he was first remanded in custody. Additionally, Stewart was placed on the sex offenders register for a period of ten years.
Following the sentencing, the victim's mother commented on the outcome, stating, 'I think he has got off lightly. But it’s closure, so we can move on.' The case has left a lasting impression on the community in Lossiemouth, highlighting the importance of protecting minors and ensuring justice is served in cases of sexual offenses involving young victims.
