PHILIP KEVIN GOLDING FROM SHETLAND CONVICTED OF ASSAULT IN MOSSBANK
A man named Philip Kevin Golding was recently found guilty of assaulting a woman during a trial held at Lerwick Sheriff Court.The proceedings lasted three days, culminating in a verdict delivered by a jury composed of eight men and seven women.
After deliberating for approximately one hour, the jury reached a majority decision that Golding had physically assaulted the woman by repeatedly pushing her onto a bed and attempting to restrain her through physical force at a residence in Mossbank on December 6 of the previous year.
Despite the conviction for assault, the jury did not find sufficient evidence to prove a charge of sexual assault related to the same incident.
Additionally, Golding was acquitted of another sexual assault charge and an alternative count of common assault against the same woman.
The court's decision reflects the complexities often involved in such cases, where the evidence must meet strict legal standards to establish guilt beyond a reasonable doubt.
Sheriff Ian Cruickshank addressed Golding directly, who is 33 years old and currently resides in Pershore, Worcestershire.
The sheriff emphasized that had Golding been convicted of the more serious sexual assault charges, the consequences could have included imprisonment.
Instead, Golding was sentenced to a fine of £800 and was issued a non-harassment order, which prohibits him from contacting or approaching the woman involved in the incident.
