May 2018 Thug who shook baby so hard it has lifelong injuries jailed for a very long time A “brutal” thug who caused brain damage to a baby by violently shaking him has been jailed for 17 years. Nigel Newton, who was previously caught “laughing” after shutting the infant in a boiler cupboard, showed no emotion when he was sentenced at Hull Crown Court, but there were gasps and muffled sobs from the packed public gallery. While on bail for assaulting the baby, the 24-year-old went on an orgy of drunken violence across Hull with another man, Ryan Mawer, 19, which included a “vicious” joint attack on a man with learning difficulties. Newton, from Withernsea, had denied attacking the baby but was convicted by a jury of causing grievous bodily harm with intent after a trial last year. He received 15 years for that offence and two years consecutively for the other violence after admitting causing grievous bodily harm, two offences of assault occasioning actual bodily harm, and affray. Sentencing Newton on Wednesday, Judge Jeremy Richardson QC, Recorder of Hull and East Riding, told him: “You richly deserve that sentence. You maimed that child.” Last week, the child’s mother was sentenced to two years in prison, suspended for two years, after pleading guilty to allowing the serious physical harm of a child. She had failed to act on warnings about the violent threat Newton posed. The judge told Newton of the attack on the baby: “The consequences of your brutality for him and his family were, and remain, exceptionally serious.” The judge said the baby was “particularly vulnerable as an infant, and the injury was exceptionally serious with potentially lifelong consequences”. He told Newton: “Your culpability is high and that is self-evidently so by deliberately shaking a baby with considerable violence.” The child had been found at a property in Withernsea in a “reduced state of consciousness, having a seizure, pale, with breathing difficulties”. He was taken to Hull Royal Infirmary, where he was found to have bleeding inside his skull and burst blood vessels in his eyes. A teacher said in a report last week he had “poor coordination”, struggled to hold a pencil and had a short concentration span. His grandmother – who branded Newton “evil” – said the older he gets the more obvious it is he is falling behind his peers. Newton, originally from Withernsea, was transferred to HRI after the attack, before returning to the prison several hours later. During his trial at Hull Crown Court, Newton for causing grievous bodily harm with intent he was described as ‘truly wicked’. A family friend who chose to remain anonymous said: ‘Nigel said afterwards he had gone out in the yard because some sort of fire had broken out inside the prison. ‘That’s when a bloke came up to him saying ‘you f****** b******, you killed a baby’, and hit him straight in the face. ‘Then two other guys joined in and started hitting him. He is not a baby killer.’ On Tuesday, July 4, Newton was found guilty of ‘vigorously shaking’ the infant, who was less than a year old. The baby was found in a ‘reduced state of consciousness, having a seizure, pale, with breaking difficulties’ with bleeding inside his skull and burst blood vessels in his eyes. As well as having seizures which required treatment, the childs condition included “weakness” on the left side of his body, affecting the movement of his left arm and leg. The baby also had a subdural collection of fluid in a cavity in his skull “that should not have any fluid in it” Other injuries included bleeding inside his skull and burst blood vessels in his eyes. Following the attack on Newton over the weekend, the female source close to the family believes it could have been prevented had prison guards been present in the yard. ‘We asked Nigel why the guards didn’t help and he said there weren’t any around. ‘They were all inside the prison dealing with the fire and the prisoners had all been left outside. ‘The family are disgusted he has been allowed to be attacked.’ Newton is currently awaiting sentencing and is due to appear at Hull Crown Court again on Friday.
