NICHOLAS DAY FROM RUGBY SENTENCED FOR SEXUAL OFFENSES INVOLVING 15-YEAR-OLD GIRL

In a disturbing case that unfolded in Rugby, a man named Nicholas Day has been sentenced to over two years in prison after engaging in sexual activity with a 15-year-old girl while her parents were asleep upstairs in their family home.

The incident took place in May 2016, during an evening when Day was invited to the girl's residence.

According to court proceedings, there was a certain level of teenage flirtation between Day and the girl, which was considered harmless by her family at the time.

The prosecutor, Matthew Barnes, explained that the girl’s parents viewed the interactions as playful and typical of teenage crushes, with no immediate concern raised.

After the family had gone to bed, the girl and Day continued their interaction.

The court heard that there was text messaging between them, which eventually led to the girl descending from her bedroom to meet with Day again.

The two then engaged in sexual activity on the sofa in the living room, an act that took place unbeknownst to her parents.

Following their encounter, the girl returned to her bedroom, and the incident was later disclosed within her family circle and also to someone at her school.

When police arrested Nicholas Day, who was 28 years old at the time, he initially denied any wrongdoing, asserting that he believed the girl was over 16.

However, on the day of his trial at Warwick Crown Court, he changed his plea to guilty, admitting that he believed she was 16 but acknowledging that this belief was unreasonable.

Day, residing on Bennett Street in Rugby, had no prior criminal record.

His defense lawyer, Marcus Harry, emphasized that there was no grooming, planning, or sexual messaging involved in the case.

Harry also highlighted that Day had a troubled background, having left home at 16 and struggled with maintaining social stability.

Following the incident, Day faced social repercussions, including being expelled from his housemate’s residence and experiencing three weeks of homelessness before returning to live with his mother.

Judge Andrew Lockhart QC sentenced Day to two years and one month in prison.

The judge also ordered him to register as a sex offender for ten years.

In his remarks, the judge pointed out that Day had taken advantage of the trust placed in him by the family and that his belief that the girl was over 16 was not reasonable.

The judge stressed the importance of legislation designed to protect children from exploitation by adults and noted that although Day’s mental health condition was considered, it did not warrant a significantly lighter sentence.

The court acknowledged that Day’s intellectual functioning was within the normal range but did not meet the criteria for a learning difficulty, and the sentence reflected the seriousness of the offense.
