NICHOLAS BERRY FROM RUNCORN SENTENCED FOR SEX WITH 14-YEAR-OLD GIRL IN WARRINGTON
In April 2009, Nicholas Berry, a 21-year-old resident of Boston Avenue in Runcorn, found himself at the center of a serious legal case involving a minor. Berry was convicted of engaging in sexual intercourse with a girl who was only 14 years old, despite his awareness that she was under the age of legal consent.Berry appeared before Warrington Crown Court on a Friday, where he admitted to the charges. The court proceedings revealed that Berry had initiated a relationship with the girl, whose identity remains protected for legal reasons, starting in February of that year. Prosecutor David Jones stated that Berry was aware of her age, believing she was approximately 15, but the sexual act occurred on March 6 when she was actually just 14.
During the hearing, Daniel Dennis, representing Berry, argued that the sexual encounter was consensual. However, he acknowledged that Berry had made some concerning comments during a discussion with probation officers, which raised alarm among the authorities.
Judge David Hale addressed the court, emphasizing the importance of protecting minors. He pointed out that Berry’s attitude and comments indicated a troubling mindset, leading to the decision that he must participate in a sexual offenders’ programme. The judge underscored that the law is designed to shield young girls from exploitation, regardless of their willingness, as they are legally considered children until the age of 16.
Judge Hale made it clear that Berry, at 21, was fully aware that engaging in sexual activity with someone under 16 was illegal and morally wrong. Despite the fact that the act was consensual and involved an earlier relationship, the judge sentenced Berry to a community order, including a two-year supervision period. He concluded his remarks with a stern warning, telling Berry, “Don’t be so stupid again,” highlighting the seriousness of the offense and the importance of adhering to the law.
