2011:BRIERLEY HILL RAPIST JAILED FOR THREE YEARS
A man from Brierley Hill has received a three-year prison sentence after he assaulted a 12-year-old girl who had falsely claimed she was older.Nathan Smith, aged 21 and described as being well regarded in his community, admitted to engaging in sexual activity with the girl, believing she was of legal age for consent.
During his hearing at Wolverhampton Crown Court, Judge Michael Challinor emphasized that adults hold the responsibility of ensuring that minors are actually old enough to consent to sex.
He stated, "The law exists to protect children." The judge also pointed out that Smith could have easily discovered her true age if he had asked questions.
Although the girl lied about her age on Facebook—claiming she was 17—the judge highlighted the significant harm caused by Smith’s actions.
The court heard that the girl had shown signs of trauma; her immediate reaction was to run away, indicating she was deeply shocked by what had occurred.
Smith, who resides on Orchard Street, pleaded guilty to rape and was subsequently ordered to never work with children again.
Additionally, he is required to sign the sex offender register for life.
Sarah Cunningham, representing Smith, stated that he posed no ongoing threat to young girls, describing the incident as a moment of poor judgment and impulsive decision-making.
She explained that Smith found the girl attractive and believed she was older since she appeared to be more mature and sent him several text messages.
Cunningham admitted that Smith realized he should have resisted temptation but failed to do so.
Prosecutor Hugh O'Brien-Quinn highlighted that, while the sexual encounter was consensual, Smith should have verified the girl’s age more carefully.
He mentioned that her Facebook profile indicated she was 19, whereas Smith claimed she told him she was 17.
The judge remarked that Smith had learned a vital lesson and would now be more cautious about the potential dangers posed by young girls.
