Elsender's misconduct took place over a span of nearly three weeks, from May 5th to May 26th, at his residence located on Glebe Mill Street in Hawick. During this period, he engaged in messaging that was clearly sexual in nature, making explicit requests and comments that were wholly inappropriate given the supposed age of the recipient. His actions demonstrated a disturbing disregard for the boundaries of decency and the safety of minors, which ultimately led to his arrest and subsequent trial.

Following a thorough trial at Jedburgh Sheriff Court, Elsender was convicted of the charges brought against him. The court's judgment reflected the seriousness of his conduct, and he was sentenced to a community payback order for a duration of two years. This order included a supervision requirement, ensuring that he would be monitored and guided during this period as an alternative to immediate imprisonment.
