A 29-year-old man named Marcus Dalby, who has previously been designated a sex offender and legally restricted from being naked in public, has recently been involved in disturbing and violent incidents in and around Ashford, Kent.

Prosecutor Sophie Stannard argued that Dalby was guilty of breaching the SHPO by exposing his buttocks, specifically by partially pulling down his underwear and revealing his backside in the direction of his teenage victim.

Conversely, Dalby's defense pointed out that his exposure was minimal—just a momentary reveal of his buttocks—which, according to their interpretation of the order and the definition of 'nakedness,' did not constitute a breach.

Judge Mark Weekes reviewed the evidence and the dictionary definition of 'having no clothes on the body,' ultimately ruling in favor of the defense.

The judge concluded that Dalby’s behavior did not legally amount to being naked, thereby determining that the original SHPO was not adequately clear or appropriate for the specific actions committed.

This decision meant that Dalby had no case to answer regarding the breach of the order.

Despite being found not guilty on the breach charge, Dalby was still subject to a plea of guilty for the assault.

The court previously listened to disturbing testimony from the woman, who was in her late teens, describing how Dalby overtook her, exposed himself, and then engaged in violent behavior.

Witnesses recounted that Dalby approached her quietly, attempted to grab her by the throat, and smeared fecal matter on his hand while defecating during the assault.

The court also heard that CCTV footage identified Dalby, leading to his arrest.

During police interviews, Dalby claimed that his actions were innocent, stating he found the girl attractive from behind and merely wanted to get her attention, hoping to make her laugh by exposing himself.

He also denied any assault, claiming that he unintentionally broke wind and attempted to catch his feces in his hand.

The victim, overwhelmed by the assault, described her ordeal emotionally.

She testified that Dalby overtook her three or four times without speaking, behaved fidgetily, and approached her multiple times.

She was deeply disgusted and confused by his actions, which she found incomprehensible.

She detailed how Dalby attempted to strangle her, describing her panic and subsequent fall to the ground.

She expressed that she screamed for help, though no one nearby heard her, and managed to run home after Dalby fled the scene.

Dalby is currently held in custody on remand while authorities await probation reports.

His sentencing is scheduled for June 17 at Canterbury Crown Court, where further legal action and sentencing will follow based on the evidence and evaluations presented.
