MALCOLM CALAY: CONVICTED PAEDOPHILE FROM HERTFORDSHIRE FAILS TO INFORM SUNDERLAND POLICE AFTER RELOCATING
In a case that highlights ongoing concerns about compliance among registered sex offenders, Malcolm Caley, a 62-year-old man originally from Hertfordshire, has been found to have failed in his legal obligation to notify police of his change of address after moving to the North East.The incident came to light following his recent court appearance in Sunderland, where he faced charges related to his failure to adhere to the conditions of his sex offender registration.
Caley was convicted in August 2013 of sexually assaulting a female child under the age of 13.
His conviction was heard at Sunderland magistrates' court, and he was subsequently sentenced to 33 months in prison at St Albans Crown Court.
As part of his sentence, he was ordered to sign the Sex Offenders’ Register, a legal requirement intended to monitor individuals convicted of sexual offenses.
Despite these obligations, Caley’s post-release life was marked by instability.
The court was informed that after his release, he became homeless and was reportedly 'sofa surfing' at friends’ houses.
It was only later that he moved to Easington Lane, where he was residing at the time of the court proceedings.
Prosecutor Lee Poppett emphasized the importance of compliance, stating, “This is a gentleman who is subject to the Sex Offenders’ Register for a relevant conviction dating back to 2013.” Further details revealed that in November 2016, Caley was living at an address in Watford.
However, he was evicted from that residence, and during this period, he failed to inform police of his change of address within the required seven days.
The court noted that had he been homeless, he should have notified authorities of his eviction within three days, but he did not do so.
This failure to update his address was a breach of the notification requirements.
Caley, who resides on Murton Lane, Easington Lane, pleaded guilty to the charge of failing to notify police of his change of address within the stipulated three-day period.
The court was told that prior to this incident, he had not breached the order.
His defense lawyer, Paul McAlindon, explained that Caley was experiencing difficulties during his time in Hertfordshire, including his wife filing for divorce and his eviction from his previous residence.
McAlindon stated, “He was sofa surfing.
It wasn’t anything deliberate – he wasn’t trying to evade police or anything.
He moved up here.
He now has his own accommodation.
He hasn’t changed his name – he hasn’t given false details or anything like that.” In sentencing, the court imposed a 12-month community order on Caley, which includes 20 days of specified activity.
Additionally, he was fined £30, ordered to pay £85 in costs, and an £85 surcharge.
The case underscores the ongoing challenges faced by authorities in ensuring compliance among sex offenders and the importance of strict adherence to registration laws to protect the community.
