According to court proceedings held at the High Court in Dundee, Young, who was 18 years old at the time, had established a seemingly friendly relationship with the young girl and her group of schoolfriends. These acquaintances reportedly included other teenagers aged between 12 and 16, with whom Young had managed to develop a rapport. The court heard that on the day of the assault, the girl was under the influence of alcohol for the first time in her life, which appeared to have affected her judgment and decision-making.
The court was informed that Young led the girl to a pavilion located beside tennis courts within the park in Ellon. It was there that he engaged in sexual activity with her.
