LAWRENCE SMITH JAILED FOR SEXUAL ASSAULT AND CHILD PORNOGRAPHY IN HERNE BAY
In December 2014, a man named Lawrence Smith from Park Road, Herne Bay, was sentenced to prison after admitting to multiple serious charges related to the sexual abuse of a young girl and possession of indecent images of children.Smith pleaded guilty to five counts of sexual assault on a girl under the age of 13.
Additionally, he admitted to making indecent photographs of children and possessing such images on his computer.
The court heard that Smith’s actions were so egregious that they prompted a strong response from the judiciary.
Judge James O’Mahony addressed Smith directly, stating, “These offences are so bad that it is difficult to find anything that can be said.
But you gave yourself up and are knuckling down to being in custody and are doing comparatively well in that way.” This comment highlighted Smith’s decision to turn himself in, which was seen as a mitigating factor in his sentencing.
Prosecutor Peter Forbes provided details of the case, revealing that Smith had inappropriately touched the young girl.
It was also disclosed that in August of the same year, Smith, who was intoxicated at the time, decided to confess his crimes to the police.
According to Mr.
Forbes, Smith made a phone call to his victim, informing her of his intentions to report himself.
Further distressing details emerged when it was reported that on October 21, Smith attempted to take his own life, overwhelmed by shame over his actions.
Authorities found indecent images of children on his computer, along with several search terms related to such material, indicating premeditation and interest.
During the hearing, defense lawyer James Howard emphasized that Smith had no prior criminal record.
He explained that alcohol abuse played a significant role in his client’s downfall, stating, “Alcohol was a factor.
He lost his business, his home and his parents and he turned to alcohol.” Howard also claimed that Smith believed he and the young girl were in a romantic relationship and that he used this misconception to justify his conduct.
Howard further explained that Smith had come across images of children while browsing adult pornography and, out of curiosity, clicked on a pop-up that led to the indecent images.
This incident was presented as a moment of poor judgment rather than malicious intent.
Ultimately, the court sentenced Lawrence Smith to a total of 46 months in prison, reflecting the severity of his crimes and the impact on his victim.
The case underscores the importance of addressing both the criminal acts and the underlying issues such as substance abuse that can contribute to such behavior.
