KYLE SMART ATTACKS HIS PARTNER ON DUNFERMLINE HIGH STREET LEAVING HER WITH A BLACK EYE
A woman in Dunfermline was left with a black eye after being physically assaulted by her partner in the town’s busy High Street.The incident occurred late at night, and two vigilant members of the public quickly intervened to assist the distressed victim, witnessing the assault firsthand.
Kyle Smart, aged 25, appeared before Dunfermline Sheriff Court to face charges related to the assault.
He pleaded guilty to the incident that took place on November 5, during which he pushed his partner and struck her on the head, causing her injury.
According to the depute fiscal Claire Bremner, the incident unfolded after the couple had been out for the evening in Dunfermline.
They had left Lourenzo’s nightclub around 1 a.m.
and were walking along the High Street when an argument erupted between them.
During this altercation, Smart pushed his partner, causing her to fall to the ground.
She managed to get back on her feet and responded by pushing him back.
It was at this point that Smart struck her with a punch to the left side of her face, then walked away from the scene.
Two members of the public, who witnessed the assault, immediately went to the victim’s aid.
They observed that she was crying and visibly upset.
Concerned for her safety, the passers-by accompanied her as she made her way home.
However, as they reached Chalmers Street, Smart approached them.
He expressed his displeasure at their involvement, asking them to leave because he claimed it was none of their business.
Despite his protests, the witnesses remained concerned and contacted the police.
Officers responded promptly at approximately 2:05 a.m.
and arrived at the scene where they found Smart, the victim, and the two witnesses present.
One of the witnesses explicitly stated to the officers, “He hit her,” confirming the assault.
The victim was noted to be crying and visibly distressed.
When questioned, Smart told police, “That’s my girlfriend.
It’s just a domestic,” before being detained by officers.
Medical assessments revealed that the victim sustained a black eye and a sore lip as a result of the attack.
Sheriff Charles MacNair ordered that reports be prepared, and the case is scheduled for sentencing on January 24.
During the hearing, Sheriff MacNair expressed concern over Smart’s attitude towards the members of the public who tried to help the victim.
He criticized Smart’s dismissive remark that it was “none of their business” and highlighted the seriousness of domestic violence, emphasizing that such behavior is unacceptable and that assaulting a partner is a grave matter.
